  2. END-USER LICENSE AGREEMENT FOR MICROSOFT SOFTWARE

  4. IMPORTANT-READ CAREFULLY: THIS MICROSOFT END-USER LICENSE 
  5. AGREEMENT ("EULA") IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN 
  6. INDIVIDUAL OR A SINGLE ENTITY) AND MICROSOFT CORPORATION FOR 
  7. THE MICROSOFT SOFTWARE PRODUCT IDENTIFIED ABOVE, WHICH 
  8. INCLUDES COMPUTER SOFTWARE AND MAY INCLUDE ASSOCIATED 
  9. MEDIA, PRINTED MATERIALS, AND "ONLINE" OR ELECTRONIC 
  10. DOCUMENTATION ("SOFTWARE PRODUCT"). BY INSTALLING, COPYING, OR 
  11. OTHERWISE USING THE SOFTWARE PRODUCT, YOU AGREE TO BE BOUND 
  12. BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF 
  13. THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE PRODUCT; YOU 
  14. MAY, HOWEVER, RETURN IT TO YOUR PLACE OF PURCHASE FOR A FULL 
  15. REFUND.

  17. SOFTWARE PRODUCT LICENSE
  18.  
  19. The SOFTWARE PRODUCT is protected by copyright laws and international 
  20. copyright treaties, as well as other intellectual property laws and treaties. The 
  21. SOFTWARE PRODUCT is licensed, not sold.
  22.  
  23. 1.  GRANT OF LICENSE. This EULA grants you the following limited, non-
  24. exclusive rights:
  25. - Installation and Use of the SOFTWARE PRODUCT. You may install and use the 
  26. enclosed SOFTWARE PRODUCT on up to five (5) computers on your premises to 
  27. design, develop, and test one or more executable files which include a service 
  28. profile generated by the SOFTWARE PRODUCT and may also include the 
  29. Redistributable Components (as defined below) and additional software for which 
  30. you have necessary rights (each such executable file individually an "Application"). 
  31. - Installation and Use of your Application(s). You may reproduce, distribute and use 
  32. your Application only if you comply with the following:  (a) your Application is 
  33. reproduced and distributed only in object code form; (b) your Application is used 
  34. only for the purpose(s) of accessing either or both of the Internet Authentication 
  35. Services and Connection Point Services of Microsoft Windows NT Server's Remote 
  36. Access Service; and (c) you do not permit redistribution of your Application by your 
  37. end users.  
  38. - Sample Code. You may modify the sample source code located in the 
  39. SOFTWARE PRODUCT's "samples" directories ("Sample Code") to design, 
  40. develop, and test your Application. You may also include the Sample Code as 
  41. modified by you in your Application and reproduce the Sample Code in object code 
  42. form as part of your Application, provided that you comply with the Redistribution 
  43. Requirements described below. 
  44. - Redistributable Code. The following portions of the SOFTWARE PRODUCT are 
  45. designated as "Redistributable Code":  the Microsoft Connection Manager 
  46. software, customizable Help files, and various default bitmaps and icons offered 
  47. during execution of the SOFTWARE PRODUCT.  You may reproduce the 
  48. Redistributable Code in object code form as part of your Application, provided that 
  49. you comply with the Redistribution Requirements described below.
  50. - Help Files. You may modify the customizable Help files contained in the 
  51. SOFTWARE PRODUCT and may also include the Help files as modified by you in 
  52. your Application, provided that you comply with the Redistribution Requirements 
  53. described below.
  54. - Redistribution Requirements. You may reproduce and/or distribute the Sample 
  55. Code and/or Redistributable Code (collectively "Redistributable Components") as 
  56. part of your Application, provided that you comply with all of the following:  (a) you 
  57. comply with all of the requirements set forth above with respect to the "Installation 
  58. and Use of your Application(s)"; (b) you do not use Microsoft's name, logo, or 
  59. trademarks in conjunction with your Application; (c) you include a valid copyright 
  60. notice on your Application; (d) you agree to provide all support services for your 
  61. Application to all of your end users; and (e) you agree to indemnify, hold harmless, 
  62. and defend Microsoft from and against any claims or lawsuits, including attorneys' 
  63. fees, that arise or result from the use or distribution of your Application. Contact 
  64. Microsoft for the applicable royalties due and other licensing terms for all other 
  65. uses and/or distribution of the Redistributable Components.
  66. - No Other License.  This EULA shall not be deemed to grant any rights to use any 
  67. software other than the SOFTWARE PRODUCT.  This EULA shall not be deemed 
  68. to grant any Client Access License to use any Microsoft product.
  69. - Reservation of Rights. Microsoft reserves all rights not expressly granted to you.

  71. 2.  DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. 
  72. - Limitations on Reverse-Engineering, Decompilation, and Disassembly. You may 
  73. not reverse- engineer, decompile, or disassemble the SOFTWARE PRODUCT or 
  74. any component thereof, whether or not included in your Application, except and 
  75. only to the extent that such activity is expressly permitted by applicable law 
  76. notwithstanding this limitation.
  77. - Software Transfer. You may permanently transfer all of your rights under this 
  78. EULA, provided the recipient agrees to the terms of this EULA.
  79. - Rental. You may not rent, lease or lend the SOFTWARE PRODUCT. 
  80. - Termination. Without prejudice to any other rights, Microsoft may terminate this 
  81. EULA if you fail to comply with the terms and conditions of this EULA. In such 
  82. event, you must destroy all copies of the SOFTWARE PRODUCT and all of its 
  83. component parts.

  85. 3.  COPYRIGHT. All rights, title, and copyrights in and to the SOFTWARE 
  86. PRODUCT (including, but not limited to, any images, photographs, animations, 
  87. video, audio, music, text, and "applets" incorporated into the SOFTWARE 
  88. PRODUCT) and any copies of the SOFTWARE PRODUCT are owned by Microsoft 
  89. or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and 
  90. international treaty provisions. Therefore, you must treat the SOFTWARE 
  91. PRODUCT like any other copyrighted material, except that you may either (a) 
  92. make one copy of the SOFTWARE PRODUCT solely for backup or archival 
  93. purposes, or (b) install the SOFTWARE PRODUCT on a single computer, provided 
  94. you keep the original solely for backup or archival purposes. You may not copy the 
  95. printed materials accompanying the SOFTWARE PRODUCT.

  97. 4.  EXPORT RESTRICTIONS. You agree that neither you nor your customers 
  98. intend to or will, directly or indirectly, export or transmit (a) the SOFTWARE 
  99. PRODUCT or related documentation and technical data, or (b) your Application as 
  100. described in Section 1 of this EULA (or any part thereof), or process, or service that 
  101. is the direct product of the SOFTWARE PRODUCT to any country to which such 
  102. export or transmission is restricted by any applicable U.S. regulation or statute, 
  103. without the prior written consent, if required, of the Bureau of Export Administration 
  104. of the U.S. Department of Commerce, or such other governmental entity as may 
  105. have jurisdiction over such export or transmission.

  107. 5.  U.S. GOVERNMENT RESTRICTED RIGHTS. The SOFTWARE PRODUCT and 
  108. documentation are provided with RESTRICTED RIGHTS. Use, duplication, or 
  109. disclosure by the Government is subject to restrictions as set forth in subparagraph 
  110. (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 
  111. 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer 
  112. Software - Restricted Rights at 48 CFR 52.227-19, as applicable. Manufacturer is 
  113. Microsoft Corporation/One Microsoft Way/Redmond, WA 98052-6399.

  115. MISCELLANEOUS
  116.  
  117. If you acquired this product in the United States, this EULA is governed by the laws 
  118. of the State of Washington. 
  119. If you acquired this product in Canada, this EULA is governed by the laws of the 
  120. Province of Ontario, Canada. Each of the parties hereto irrevocably attorns to the 
  121. jurisdiction of the courts of the Province of Ontario and further agrees to commence 
  122. any litigation that may arise hereunder in the courts located in the Judicial District 
  123. of York, Province of Ontario. 
  124. If this product was acquired outside the United States, local law may apply.

  130. LIMITED WARRANTY

  132. NO WARRANTIES. Microsoft expressly disclaims any warranty for the 
  133. SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related 
  134. documentation is provided "as is" without warranty of any kind, either express or 
  135. implied, including, without limitation, the implied warranties or merchantability, 
  136. fitness for a particular purpose, or noninfringement. The entire risk arising out of 
  137. use or performance of the SOFTWARE PRODUCT remains with you.
  138. NO LIABILITY FOR DAMAGES. In no event shall Microsoft or its suppliers be 
  139. liable for any damages whatsoever (including, without limitation, damages for loss 
  140. of business profits, business interruption, loss of business information, or any other 
  141. pecuniary loss) arising out of the use of or inability to use this Microsoft product, 
  142. even if Microsoft has been advised of the possibility of such damages. Because 
  143. some states/jurisdictions do not allow the exclusion or limitation of liability for 
  144. consequential or incidental damages, the above limitation may not apply to you.
