  1. Welcome to the Crescent Upgrade Wizard for Visual Basic 4.0.
  2. This tool assists you in transitioning your VB 3.0 projects
  3. to run on 16- and 32-bit Visual Basic 4.0.

  28.  
  29. CAUTION:  OPENING THE MEDIA PACKAGE INDICATES YOUR UNDERSTANDING
  30. AND ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS.  PLEASE
  31. CAREFULLY READ THESE TERMS AND CONDITIONS BEFORE OPENING THE
  32. SEALED PACKAGE.  IF YOU DO NOT AGREE WITH THEM, PROMPTLY RETURN
  33. THE UNOPENED PACKAGE TO PROGRESS SOFTWARE CORPORATION OR THE
  34. DISTRIBUTOR FROM WHICH IT WAS ACQUIRED.

  36. Subject to the following terms and conditions,
  37. Progress Software Corporation (PSC) grants to you ("User")
  38. a non-exclusive license to use the enclosed software Product(s)
  39. and related manuals ("Documentation").
  40.  
  41. 1.    Scope of License.
  42.  
  43. 1.1  This license allows User to install and use the Product
  44. solely on a single computer (i.e. with a single central
  45. processing unit).
  46.  
  47. 1.2  The Product may not be transferred, sold, assigned,
  48. or otherwise conveyed by User to another party without PSC's
  49. prior written consent.  Transfer of the Product to another
  50. computer may be made on a permanent basis provided no active
  51. copies are retained on the original computer.
  52.  
  53. 1.3  A Product Update replaces part or all of a Product
  54. or Product Update previously licensed.  Use of a Product
  55. Update terminates the license to use the Product or that
  56. part of the Product which the Product Update replaces and
  57. User shall destroy or return to PSC all copies of any prior
  58. Product or Product Update.

  60. 1.4  User may not grant sublicenses, leases, or other rights
  61. in the Product to others.
  62.  
  63. 1.5  User may obtain rights to acquire Product Updates and
  64. other technical services under PSC's then current fees and
  65. terms.
  66.  
  67. 1.6  This Agreement automatically terminates if User transfers
  68. possession of any copy of the Product or Product Update to
  69. another party.
  70.  
  71. 2.    Progress Software's Rights.  The Product and Documentation
  72. are proprietary products of PSC, or its licensor(s), and are
  73. protected by copyright law.  By virtue of this Agreement, User
  74. acquires only the non-exclusive right to use the Product and does
  75. not acquire any rights of ownership in the product or the media
  76. upon which it is embodied.  PSC, or its licensor(s) shall at all
  77. times retain all rights, title, and interest in the Product and
  78. the media.
  79.  
  80. 3.    Non-Disclosure; Copies; Alterations.  User agrees not to
  81. cause or permit the reverse engineering, disassembly, copying, or
  82. decompilation of the Product, except to reproduce machine-readable
  83. object code portions for backup purposes and installation of new
  84. releases, under penalty of license termination but not exclusive
  85. of any other remedies.  User may copy the Product for installation,
  86. backup or other purposes as described in the Documentation. 
  87. User may not copy nor allow others to copy the Product or Product
  88. Update for any other purpose.  User agrees not to remove any product
  89. identification, copyright notices, or other notices or proprietary
  90. restrictions from the Product.  User may not copy nor allow others
  91. to copy any part of the manuals or other printed material provided
  92. with the Product or Product Update by any means, including data
  93. transmission or translation.

  97. 4.    Limited Warranty.
  98.  
  99. PSC warrants that the materials of both the Product media and
  100. Documentation are not defective and that the software is properly
  101. recorded on the media.  If either the media or the Documentation is
  102. physically defective, PSC will replace it free of charge during the
  103. 60-day warranty period.  User's remedy is limited to return of the
  104. media and/or Documentation to the supplier or to PSC for replacement.
  105. This Limited Warranty is in effect for claims made within 60 days from
  106. User's purchase of the Product.
  107.  
  108. PSC warrants that it has the right to license the Product(s).  PSC will
  109. defend User against any claim based on an allegation that a Product
  110. infringes a U.S. patent or copyright, but only if PSC is notified promptly
  111. in writing of such claim and is given sole control of the defense thereof
  112. and all related settlement negotiations relating thereto.  Notwithstanding
  113. the foregoing, PSC shall not be liable to User for any claim arising from
  114. or based upon the alteration or modification of any of the Product(s).

  116. The Product has been tested and the Documentation has been reviewed. 
  117. However, except as specifically stated above, PSC MAKES NO WARRANTY OR
  118. REPRESENTATION, EITHER EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF
  119. MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO
  120. THIS PRODUCT AND DOCUMENTATION.  For example, PSC does not warrant that
  121. there are no discrepancies between the Product and the Documentation,
  122. nor that errors cannot arise during the use of the Product.

  124. THIS WARRANTY GIVES THE USER SPECIFIC LEGAL RIGHTS, AND MAY ALSO IMPLY
  125. OTHER RIGHTS WHICH VARY FROM STATE TO STATE.  SOME STATES DO NOT ALLOW
  126. THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, AND DO NOT ALLOW A 
  127. LIMITATION ON HOW LONG ANY IMPLIED WARRANTY LASTS, SO THE ABOVE
  128. LIMITATIONS MAY NOT APPLY.  No PSC employee, supplier, or agent is
  129. authorized to make any modifications or addition to this warranty.

  131. 5.    Limitation of Liability.  TO THE EXTENT PERMITTED BY APPLICABLE
  132. LAW, THE LIABILITY OF PSC, IF ANY, FOR DAMAGES RELATING TO ANY PRODUCTS
  133. SHALL BE LIMITED TO THE ACTUAL AMOUNTS PAID BY USER FOR SUCH PRODUCT AND
  134. SHALL IN NO EVENT INCLUDE INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND.
  135. SOME STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL
  136. DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY.
  137.  
  138. 6.    Export Administration.  User agrees to comply fully with all
  139. relevant regulations of the United States Department of Commerce and
  140. with the United States Export Administration Act to assure that the
  141. Product and Documentation are not exported or re-exported in violation
  142. of United States law.  Further, User shall not directly or indirectly
  143. export or re-export any Products, Documentation, or the direct Product
  144. thereof without first obtaining PSC's written approval.
  145.  
  146. 7.    U.S. Government Restricted Rights.  The product is provided
  147. with RESTRICTED RIGHTS.  Use, duplication or disclosure by the U.S.
  148. Government is subject to restrictions as set forth in subparagraph
  149. (c)(1)(ii) of The Rights in Technical Data and Computer Program Product
  150. clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the
  151. Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as 
  152. applicable.  Contractor/manufacturer is Progress Software Corporation,

  156. 8.    Governing Law.  This Agreement is governed by the laws of the 
  157.  
  158. Commonwealth of Massachusetts.
