  1. NOTICE: Your download and use of any Corel patches, plugs, updates or other files 
  2. located at this site ("Software") is subject to Corel's Limitations of Warranties 
  3. and Liabilities and end user Eligibility certifications.

  5. By downloading the Software you certify that you have read, understand and agree 
  6. to comply with and be bound by the following terms and conditions. If you do not 
  7. agree with the terms and conditions do not download the Software.  In the event an 
  8. end user license agreement accompanies the particular Software file you download 
  9. then the terms and conditions of that end user license agreement will supercede 
  10. the terms and conditions presented to you below.

  12. If the Software is designed for use with a Corel application software product (the 
  13. "Original Application"), you are granted a non-exclusive license to use such 
  14. Software only with the Original Application provided that you still possess a 
  15. valid license from Corel for the Original Application. Except as provided below, 
  16. the Software provided to you, and use of the Software and the Original Application 
  17. by you, is subject to the terms and conditions of the end user license agreement 
  18. from Corel accompanying the Original Application.

  20. All risk of damage to the Software during transmission and download is assumed by you.

  22. LIMITATIONS OF WARRANTIES AND LIABILITY: THIS SOFTWARE IS PROVIDED AND LICENSED BY
  23. COREL ON AN "AS IS" BASIS, WITHOUT ANY OTHER WARRANTIES OR CONDITIONS, EXPRESS OR
  24. IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE QUALITY,
  25. SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE
  26. ARISING BY LAW, STATUTE, USAGE OF TRADE, COURSE OF DEALING OR OTHERWISE.  THE ENTIRE
  27. RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.  NEITHER
  28. COREL NOR ITS DEALERS OR SUPPLIERS SHALL HAVE ANY LIABILITY TO YOU OR ANY OTHER
  29. PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  30. WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, LOST OR DAMAGED
  31. DATA OR OTHER COMMERCIAL OR ECONOMIC LOSS, EVEN IF COREL HAS BEEN ADVISED OF THE
  32. POSSIBILITY OF SUCH DAMAGES, OR THEY ARE FORESEEABLE. COREL IS ALSO NOT RESPONSIBLE
  33. FOR CLAIMS BY A THIRD PARTY.   THE LIMITATIONS SET FORTH HEREIN SHALL APPLY WHETHER OR
  34. NOT THE ALLEGED BREACH OR DEFAULT IS A BREACH OF A FUNDAMENTAL CONDITION OR TERM OR
  35. A FUNDAMENTAL BREACH.  SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR
  36. LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE
  37. LIMITATION MAY NOT APPLY TO YOU.

  39. ELIGIBILITY:  To be eligible to download the Software you must be in compliance with 
  40. applicable export laws.  By downloading the Software you are representing and 
  41. warranting to Corel you are compliant with the following statements:
  42. (i) you are not a citizen, national or resident of, and are not under the control of, 
  43. the government of : Cuba, Iran, Iraq, Libya, North Korea, Syria, nor any other 
  44. country to which the United States has prohibited export; (ii) you will not download 
  45. or otherwise export or re-export the Software, directly or indirectly, to the 
  46. countries mentioned in clause (i) nor to citizens, nationals or residents of those 
  47. countries; (iii) you are not listed in the United States Department of Treasury lists 
  48. of Specially Designated Nationals, Specially Designated Terrorists, and Specially 
  49. Designated Narcotic Traffickers, nor are you listed on the United States Department 
  50. of Commerce Table of Denial Orders; (iv) you will not download or otherwise export or 
  51. re-export the Software, directly or indirectly, to persons on the lists mentioned in 
  52. clause (iii); and (v) you will not use the Software for, and will not allow the 
  53. Software to be used for, any purposes prohibited by United States law, including, 
  54. without limitation, for the development, design, manufacture or production of nuclear, 
  55. chemical or biological weapons of mass destruction.

  57. If you cannot represent and warrant that you are in compliance with the above 
  58. statements, you are not eligible to download the Software.

  61. BY CHOOSING TO DOWNLOAD THE SOFTWARE YOU AGREE:

  63.      a)   TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET OUT ABOVE; AND
  64.      b)   TO BE RESPONSIBLE FOR ANY AND ALL INTERNET SERVICE PROVIDER FEES,
  65.      TELECOMMUNICATION AND OTHER CHARGES THAT MAY APPLY AS A RESULT OF YOUR
  66.      DOWNLOAD AND/OR INSTALLATION OF THE SOFTWARE.

  68. IF YOU DO NOT AGREE WITH THE ABOVE TERMS AND CONDITIONS, DO NOT DOWNLOAD THE
  69. SOFTWARE.

  71. IF YOU ARE DOWNLOADING THE SOFTWARE ON BEHALF OF A COMPANY, YOU REPRESENT AND
  72. WARRANT TO COREL THAT YOU HAVE FULL AUTHORITY TO BIND SUCH COMPANY.
