  12. LICENSE

  14. DISCLAIMER OF WARRANTY. Optasia Electronics' Software is 
  15. provided on an "AS IS" basis, without warranty of any 
  16. kind, including without limitation the warranties of 
  17. merchantability, fitness for a particular purpose and 
  18. non-infringement. In addition, the security mechanisms 
  19. implemented by Optasia Electronics' Software have 
  20. inherent limitations, and you must determine that the 
  21. Software sufficiently meets your requirements. This 
  22. disclaimer of warranty constitutes an essential part of 
  23. the agreement. SOME JURISDICTIONS DO NOT ALLOW 
  24. EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS DISCLAIMER 
  25. MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL RIGHTS 
  26. THAT VARY BY JURISDICTION.

  29. SCOPE OF GRANT.

  31. You may:

  33. ╖ use the Software on one computer; 
  34. ╖ make backup copies of the Software, provided that 
  35. it is for archival purposes.  If interested in 
  36. distributing our product, contact Optasia Electronics,

  39. You may not:

  41. ╖ make illegal copies of the Software;
  42. ╖ rent, lease, sell, grant a security interest in; or 
  43. ╖ remove any proprietary notices or labels on the 
  44. Software.

  46. TITLE. Title, ownership rights, and intellectual 
  47. property rights in the Software shall remain in 
  48. Optasia Electronics and/or its suppliers. The Software 
  49. is protected by copyright laws and treaties. Title 
  50. and related rights in the content accessed through the 
  51. Software is the property of the applicable content 
  52. owner and may be protected by applicable law. This 
  53. License gives you no rights to such content. Regarding
  54. raw book text, only the Optasia Topical Concordance 
  55. is copyrighted. All programming, graphics, structure, 
  56. etc. is copyrighted Optasia Electronics, Inc.

  59. TERMINATION. The license will terminate automatically 
  60. if you fail to comply with the limitations described 
  61. herein. On termination, you must destroy all copies 
  62. of the Software.

  65. EXPORT CONTROLS. None of the Software or underlying 
  66. information or technology may be downloaded or 
  67. otherwise exported or reexported by you (i) into (or 
  68. to a national or resident of) Cuba, Iraq, Libya, 
  69. Yugoslavia, North Korea, Iran, Syria or any other 
  70. country to which the U.S. has embargoed goods; or 
  71. (ii) to anyone on the U.S. Treasury Department's list 
  72. of Specially Designated Nationals or the U.S. 
  73. Commerce Department's Table of Denial Orders. By 
  74. downloading or using the Software, you are agreeing 
  75. to the foregoing and you are representing and 
  76. warranting that you are not located in, under the 
  77. control of, or a national or resident of any such 
  78. country or on any such list. LIMITATION OF LIABILITY. 
  79. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, 
  80. TORT, CONTRACT, OR OTHERWISE, SHALL OPTASIA ELECTRONICS
  81. OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY 
  82. OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, 
  83. OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, 
  84. WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, 
  85. WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR 
  86. ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO 
  87. EVENT WILL OPTASIA ELECTRONICS BE LIABLE FOR ANY DAMAGES 
  88. IN EXCESS OF THE AMOUNT OPTASIA ELECTRONICS RECEIVED 
  89. FROM YOU FOR A LICENSE TO THE SOFTWARE, EVEN IF OPTASIA 
  90. ELECTRONICS SHALL HAVE BEEN INFORMED OF THE POSSIBILITY 
  91. OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. 
  92. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO 
  93. LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT 
  94. APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE, 
  95. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR 
  96. LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO 
  97. THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

  100. HIGH RISK ACTIVITIES. The Software is not fault- 
  101. tolerant and is not designed, manufactured or 
  102. intended for use or resale as on-line control 
  103. equipment in hazardous environments requiring fail- 
  104. safe performance, such as in the operation of nuclear 
  105. facilities, aircraft navigation or communication 
  106. systems, air traffic control, direct life support 
  107. machines, or weapons systems, in which the failure of 
  108. the Software could lead directly to death, personal 
  109. injury, or severe physical or environmental damage 
  110. ("High Risk Activities"). Optasia Electronics and its 
  111. suppliers specifically disclaim any express or 
  112. implied warranty of fitness for High Risk Activities.

  115. MISCELLANEOUS. This Agreement represents the complete 
  116. agreement concerning this license and may amended 
  117. only by a writing executed by both parties. If any 
  118. provision of this Agreement is held to be 
  119. unenforceable, such provision shall be reformed only 
  120. to the extent necessary to make it enforceable. This 
  121. Agreement shall be governed by the laws of the State 
  122. of Indiana. The application the United Nations 
  123. Convention of Contracts for the International Sale of 
  124. Goods is expressly excluded.

  127. U.S. GOVERNMENT RESTRICTED RIGHTS. Use, duplication 
  128. or disclosure by the Government is subject to 
  129. restrictions set forth in subparagraphs (a) through 
  130. (d) of the Commercial Computer-Restricted Rights 
  131. clause at FAR 52.227-19 when applicable, or in 
  132. subparagraph (c)(1)(ii) of the Rights in Technical 
  133. Data and Computer Software clause at DFARS 252.227- 
  134. 7013, or at 252.211-7015, and in similar clauses in 
  135. the NASA FAR Supplement.

  140. OPERATING INSTRUCTIONS 
  141.  
  142. Using Windows 95, NT, 98, or ME 
  143.  
  144. 1. Insert CD into CD ROM drive.  The Bible Master 
  145. autorun screen should appear.  Click on the "Install 
  146. Bible Master" Button and follow the directions given. 
  147. Note ~ opening Default.html constitutes your 
  148. acceptance of the software license. 
  149. 2. If autorun screen does not appear, follow these 
  150. directions:
  151.    a) In Windows Explorer, click on drive for CD ROM 
  152.    (usually D:\ or E:\).
  153.    b) Double click on the readme.txt for license 
  154.    agreement. 
  155.    c) Double click on the autorun.exe file, and follow 
  156.    the directions given for installation.
  157. 3. Now, insert Bible Master Library CD into your CD-ROM 
  158. drive, and the Bible Master Library autorun screen 
  159. should appear.  Click on the "Bible Master Library" 
  160. Button and the library will initiate. 
  161. 4. If you are having complications, double click on the 
  162. Default.html file from Windows Explorer and the software 
  163. will start. Note ~ opening Default.html constitutes 
  164. your acceptance of the software license.
