  4.     Street person Richard Kreimer won national attention -- and a
  5. potful of cash -- when he sued the public library in
  6. Morristown, N.J., over a patron code of conduct that banned
  7. homeless people with poor personal hygiene. But the self-styled
  8. "homeless Ralph Nader" found himself barred from the building
  9. once again last week when a federal appeals court in
  10. Philadelphia overturned his victory and upheld the right of
  11. public libraries to expel vagrants in certain circumstances. A
  12. lower court had said the rules were an infringement of Kreimer's
  13. First Amendment rights, but the three-judge appeals panel
  14. disagreed. Although the library is a public forum, it "need not
  15. be used as a lounge or a shelter," wrote Judge Morton I.

  18.     Kreimer became a minor celebrity when he took Morristown
  19. to court in a separate action over alleged police harassment.
  20. Although town officials denied the charges, they settled his
  21. case for $150,000 rather than engage in a protracted and costly
  22. court action. Kreimer received an additional $80,000 payment two
  23. months ago from the library's insurance company, which chose to
  24. settle his claim before the appeals court issued its ruling.
