  10. BY COPYING OR USING THIS PROGRAM, YOU INDICATE YOUR AGREEMENT TO
  11. THE FOLLOWING TERMS, WHICH ARE THE ONLY ONES BY WHICH 3D REALMS
  12. PERMITS COPYING OR USE. THIS PROGRAM IS NOT SHAREWARE.
  13. DISTRIBUTING IT WITHOUT 3D REALMS'S PERMISSION IS ILLEGAL.

  15. [1] OWNERSHIP.  Except to the extent expressly licensed by us, we have and
  16.     reserve the exclusive copyright, trade secret and other rights to the
  17.     Program, and the right to use the Trademarks "Apogee", the Apogee Comet
  18.     "logo", "3D Realms", the 3D Realms logo, "Shadow Warrior", "Lo Wang",
  19.     and any of the characters contained within the Game in connection with it.

  21. [2] USE AND COPIES. You may use the Program only for your own purposes "just
  22.     like a book."  This permits use by any number of people on any number of
  23.     machines to use it so long as -- just like a book -- there is NO
  24.     POSSIBILITY that more than one copy will be used at a time.  You have no
  25.     right to copy this Program except for legal backups.

  27. [3]  NEW LEVELS.
  28.  
  29.      "New Levels" are data that modify or substitute for Game data, thus
  30.      modifying or replacing one or more Game levels.  Creating or distributing
  31.      a New Level or a software tool that has no substantial purpose other than
  32.      to contribute to the creation of a New Level infringes rights of 3D Realms
  33.      and is prohibited by law except as permitted by 3D Realms.  3D REALMS PERMITS
  34.      NEW LEVELS ONLY THAT MEET ALL OF THE FOLLOWING CONDITIONS:

  36.  [A] The Level must only work with a RETAIL version of the Game (not the
  37.      shareware version).
  38.  
  39.  [B] The level must not contain modifications to any COM, EXE, or DLL, or to
  40.      other executable file.
  41.  
  42.  [C] The level must not contain any illegal material, or (without
  43.      appropriate irrevocable licenses) any trademarks, copyright protected
  44.      work, or other property of third parties.
  45.  
  46.  [D] The level must prominently identify at least in every online description
  47.      and with reasonable duration on an opening screen
  48.      (1) the name and email address of the level's creators, and
  49.      (2) the words "THIS LEVEL IS NOT MADE BY OR SUPPORTED BY 3D REALMS".

  51.  [E] The level and any use of it must be offered solely for free (other than
  52.      any incidental online charges).
  53.  
  54.  [F] By distributing or permitting the distribution of any New Level, all
  55.      owners of any trademark, copyright or other right, title or interest
  56.      therein (to the extent different from the Game as originally distributed
  57.      by 3D Realms) grant back to 3D Realms an irrevocable royalty free right
  58.      to distribute the level.

  60.  [G] The distributor of any New Level or Level Editor must be authorized to
  61.      distribute the Game itself (either in writing, or by being within a
  62.      category where no writing is needed under this LICENSE.DOC).

  64. [4] LIMITED WARRANTY AND LIMITATION OF REMEDIES
  65.  
  66.     If this Program (including any related written material)
  67.     contained a physical defect, you may receive a replacement if
  68.     you return it within 90 days of receiving it from 3D Realms.
  69.     Aside from this, IT IS PROVIDED "AS-IS", AND NO WARRANTIES OF
  70.     ANY KIND (INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR
  71.     FITNESS FOR A PARTICULAR PURPOSE), EXPRESS OR IMPLIED, ARE
  72.     MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.  OUR ENTIRE
  73.     LIABILITY AND YOUR EXCLUSIVE REMEDY IS SUCH REPLACEMENT, AND
  74.     UNDER NO CIRCUMSTANCES WILL WE PROVIDE ANY OTHER REMEDY FOR
  75.     DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE,
  76.     INCIDENTAL OR OTHER DAMAGES ARISING FROM IT, INCLUDING SUCH
  77.     FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR
  78.     CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH
  79.     DAMAGES.  Some states do not allow the exclusion or
  80.     limitation of implied warranties or liability for incidental
  81.     or consequential damages, so this may not apply to buyers of
  82.     the Program. This gives you specific legal rights, and you
  83.     may also have other rights which vary from state to state.

  87.     [A] With respect to every matter arising under this, you consent to the
  88.         exclusive jurisdiction and venue of the state and federal courts
  89.         sitting in Dallas, Texas and to service by certified mail, return
  90.         receipt requested, or as otherwise permitted by law.

  92.     [B] You will not modify, reverse compile, disassemble, or reverse engineer
  93.         the Program, or use or disclose any of our secret information that it
  94.         contains.
