  4. Software Licence Agreement and Limited Warranty

  6. This legal document is an agreement between you, the end user, and
  7. NB Information Limited ("NB Information") for the software
  8. accompanying this agreement, which includes computer software, any
  9. associated media, printed materials and electronic documentation
  10. ("Software").  By running the installation program for the Software
  11. you are agreeing to become bound by the terms of this agreement,
  12. which includes the software licence and limited warranty.  If you
  13. do not agree to the terms of this agreement, choose "No" to prevent
  14. the installation from continuing.  If the Software was purchased by
  15. you, you may return it to your place of purchase for a full refund.
  16.  
  17. NB Information Software Licence
  18.  
  19. This Software is protected by copyright laws and international
  20. copyright treaties, as well as other intellectual property laws and
  21. treaties.  The Software is licensed, not sold.
  22.  
  23. 1. GRANT OF LICENCE. The Software is licensed as follows:

  25. * Evaluation.  Subject to the terms below, NB Information grants
  26. you the right to install and use a copy of the Software for
  27. evaluation purposes without charge for a period of 30 days.  If you
  28. use this software after the 30 day evaluation period a licence fee
  29. of 21.27 pounds sterling must be paid, together with applicable
  30. taxes.
  31.  
  32. * Installation and Use.  In consideration of payment of the licence
  33. fee, and your agreement to abide by the terms and conditions of this
  34. Licence and the Limited Warranty, NB Information grants you a
  35. nonexclusive right to install and use a copy of the Software on a
  36. single computer so long as you comply with the terms of this
  37. Licence.

  39. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  41. * Maintenance of Copyright Notices.  You must not remove or alter
  42. any copyright notices on any parts of the Software.
  43.  
  44. * Distribution.  You may not distribute copies of the Software to
  45. third parties.
  46.  
  47. * Prohibition on Reverse Engineering, Decompilation, and
  48. Disassembly. You may not reverse engineer, decompile, or
  49. disassemble the Software, except and only to the extent that such
  50. activity is expressly permitted by applicable law notwithstanding
  51. this limitation.
  52.  
  53. * Termination.  Without prejudice to any other rights, NB
  54. Information may terminate this agreement if you fail to comply with
  55. the terms and conditions of the agreement.  In such event, you must
  56. destroy all copies of the Software and all of its component parts.
  57.  
  58. 3. COPYRIGHT.  All title, including but not limited to copyrights,
  59. in and to the Software and any copies thereof are owned by NB
  60. Information or its suppliers.  All rights not expressly granted are
  61. reserved by NB Information.
  62.  
  63. 4. MISCELLANEOUS. This Licence shall be governed and construed in
  64. accordance with the laws of England and shall benefit NB
  65. Information, its successors and assigns.
  66.  
  67. Limited Warranty and Disclaimer of Warranty
  68.  
  69. THE SOFTWARE AND ACCOMPANYING WRITTEN MATERIALS
  70. (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS"
  71. WITHOUT WARRANTY OF ANY KIND. FURTHER, NB INFORMATION
  72. DOES NOT WARRANT, GUARANTEE OR MAKE ANY
  73. REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF
  74. USE, OF THE SOFTWARE OR WRITTEN MATERIALS IN TERMS OF
  75. CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR
  76. OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND
  77. PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. IF THE
  78. SOFTWARE OR WRITTEN MATERIALS ARE DEFECTIVE YOU, AND
  79. NOT NB INFORMATION OR ITS DEALERS, DISTRIBUTORS,
  80. AGENTS, OR EMPLOYEES, ASSUME THE ENTIRE COST OF ALL
  81. NECESSARY SERVICING, REPAIR, OR CORRECTION.

  83. THE ABOVE IS THE ONLY WARRANTY OF ANY KIND, EITHER
  84. EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE
  85. IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
  86. A PARTICULAR PURPOSE, THAT IS MADE BY NB INFORMATION
  87. ON THIS NB INFORMATION PRODUCT. NO ORAL OR WRITTEN
  88. INFORMATION OR ADVICE GIVEN BY NB INFORMATION, ITS
  89. DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYEES SHALL
  90. CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF
  91. THIS WARRANTY AND YOU MAY NOT RELY ON ANY SUCH
  92. INFORMATION OR ADVICE. YOU MAY HAVE OTHER RIGHTS
  93. WHICH VARY FROM STATE TO STATE. NEITHER NB
  94. INFORMATION NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN
  95. THE CREATION, PRODUCTION OR DELIVERY OF THIS PRODUCT
  96. SHALL BE LIABLE FOR ANY DIRECT, INDIRECT,
  97. CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING
  98. DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
  99. INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE
  100. LIKE) ARISING OUT OF THE USE OR INABILITY TO USE SUCH
  101. PRODUCT EVEN IF NB INFORMATION HAS BEEN ADVISED OF
  102. THE POSSIBILITY OF SUCH DAMAGES.
  103.  
  104. This Limited Warranty shall be governed and construed in accordance
  105. with the laws of England.
