  4. License Agreement and Statement of Warranty

  6. By installing NoteWorthy Composer on your system, you indicate 
  7. your agreement to the following terms and conditions. Please 
  8. carefully read these terms and conditions prior to continuing
  9. with the use of this software.

  11. UNREGISTERED SHAREWARE VERSION
  12. =======================================================
  13. The license information in this section applies only to the 
  14. unregistered version of NoteWorthy Composer. If you have 
  15. registered and are installing a new registered version, skip 
  16. to the section titled REGISTERED VERSION.
  17.  
  18. Evaluation License: NoteWorthy Composer is not a free program. 
  19. You are hereby granted a limited license to use this version of 
  20. NoteWorthy Composer for up to 30 days before you are required to 
  21. purchase a complete license. If you elect not to purchase 
  22. NoteWorthy Composer at the end of 30 days, you must discontinue 
  23. the use of it and remove it from your computer.

  25. Distribution License: You are hereby granted a limited license 
  26. to distribute the unregistered Shareware version of NoteWorthy
  27. Composer, provided that you satisfy the following conditions:

  29. Condition 1: You may not charge a fee of any kind to the 
  30. beneficiary of the distribution, except to cover the cost 
  31. of the materials used in the distribution or the cost of 
  32. on-line computer time in the course of the beneficiary 
  33. downloading the application.

  35. Condition 2: The NoteWorthy Composer application must be 
  36. distributed in its entirety, including its setup executable, 
  37. help file, order and license text, and all included notation 
  38. DLL files.

  40. Any distribution not complying to the above conditions 
  41. without the prior, written consent of NoteWorthy ArtWare 
  42. is in violation of United States and International copyright 
  43. laws.

  45. REGISTERED VERSION

  47. As a licensed user of NoteWorthy Composer, you are 
  48. entitled to install NoteWorthy Composer on one machine 
  49. and enjoy unrestricted use of its capabilities. You may 
  50. also install NoteWorthy Composer on a second machine 
  51. provided that it will never be in simultaneous use on 
  52. more than one machine. Please protect your registration 
  53. codes, as these are intended to be used only by you.

  55. WARRANTY DISCLAIMER

  57. The NoteWorthy Composer application and its accompanying 
  58. support files are provided "as is" and no warranty of 
  59. fitness for a particular use or purpose is offered. 
  60. The entire and exclusive liability implied by this 
  61. agreement shall be limited to the replacement of 
  62. defective diskette(s). Liability shall not include or 
  63. extend to any claim for or right to recover any other 
  64. damages, including but not limited to loss of profit, 
  65. data, or use of NoteWorthy Composer or other software, 
  66. or special, incidental, or consequential damages or 
  67. other similar claims, even if NoteWorthy ArtWare has been 
  68. specifically advised of the possibility of such damages. 
  69. In no event will NoteWorthy ArtWare's liability for any 
  70. damages to you or any other party ever exceed the actual 
  71. price paid for the license to use NoteWorthy Composer.

  74. warranties, expressed or implied, including but not 
  75. limited to any implied warranty of merchantability or 
  76. fitness for a particular purpose.
