  2.         Adabas D End User License Terms

  5. THE ADABAS D PERSONAL EDITION LICENSE AGREEMENT
  6. (This is a license and not a sale)
  7.  
  8. 1. Software AG grants you a nontransferable and non-exclusive license
  9. to use the enclosed Software AG software program(s) ("Software") and 
  10. its documentation, solely for your own internal data processing and 
  11. computing needs. The Licensee is solely for the use as an intgrated
  12. product of StarOffice.
  13.  
  14. ADABAS D Personal Edition Software is defined as Software which may 
  15. execute on the following platforms, such as, but not limited to: 
  16. Windows 95, Windows 98 and Windows NT 4.0. 
  17. Each ADABAS D Personal Edition Client Software on a multi-user 
  18. computer or a local area network must have a valid license from 
  19. Software AG. 
  20.  
  21. This free Personal Edition of ADABAS D is a single user, non-shared
  22. database use version, and contains the following restrictions:
  23.  
  24.     - No Support
  25.     - Maximum 100 MB database size
  26.     - Maximum of three (3) concurrent sessions
  27.     - No distributed database functionality
  28.  
  29. Software AG does not provide any support for the installation and/or 
  30. usage of this ADABAS D Personal Edition. 
  31.  
  32. 2. You may not sublicense, assign, rent, lease or otherwise convey 
  33. the right to use the Software; any attempt to do so (whether or not 
  34. successful), terminates this license to use the Software without 
  35. refund of any fees paid.
  36.  
  37. 3. Software AG further grants you the right to make a backup archival
  38. copy of the Software as set forth in Paragraph 4. 
  39. You may not decompile, disassemble, reverse engineer, copy, transfer 
  40. or otherwise use the Software except as stated in this Agreement. 
  41. Some documentation for the Software contained in the package may 
  42. be viewable using  a utility called WordView, which is a product 
  43. of Interleaf GmbH. The usage authorization for backup and archival 
  44. copyright notification and restrictions granted for the Software 
  45. also applies to WordView. SOFTWARE AG MAKES NO WARRANTY WHATSOEVER 
  46. AS TO THE WORDVIEW SOFTWARE, WHICH IS PROVIDED "AS IS".

  48. 4. The Software, and its associated Adabas D Personal Edition 
  49. documentation are proprietary products of Software AG and are 
  50. protected by copyright laws and international treaties. 
  51. You must treat the Software like any other copyrighted material, 
  52. except that you may either make copies of the Software for 
  53. backup or archival purposes, or you may place the ADABAS D Server 
  54. Software on a single server and the ADABAS D Client Software on 
  55. a single hard disk for each user provided that you keep the 
  56. Software solely for backup or archival purposes. Copyright laws 
  57. prohibit making additional copies of the Software for any other 
  58. reason. You may not copy the documentation and/or other written 
  59. materials without the written permission of Software AG.

  61. 5. LIMITED WARRANTY/LIMITATION OF REMEDIES: SOFTWARE AG PRODUCTS ARE 
  62. LICENSED "AS IS". SOFTWARE AG MAKES NO WARRANTIES WHATSOEVER, AND 
  63. SUCH WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED,
  64. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF 
  65. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO 
  66. THE SOFTWARE AND THE ACCOMPANYING DOCUMENTATION. THE ENTIRE RISK AS 
  67. TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.

  69. IN NO EVENT WILL SOFTWARE AG BE LIABLE TO YOU FOR DIRECT OR INDIRECT 
  70. DAMAGES, INCLUDING ANY LOSS OF PROFITS OR OTHER INCIDENTAL OR 
  71. CONSEQUENTIAL DAMAGES, ARISING OUT OF YOUR USE OF OR INABILITY TO 
  72. USE THE SOFTWARE EVEN IF SOFTWARE AG OR AN AUTHORIZED SOFTWARE 
  73. REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  75. 6. Software AG may terminate this License Agreement in the event 
  76. that Licensee breaches any of the terms and conditions of this 
  77. Agreement and that the breach is not cured within thirty (30) days 
  78. after receipt of written notice of the breach from Software AG. 
  79. Upon receipt of written termination notice, Licensee shall cease 
  80. using the Software.

  82. 7. If any provision of this Agreement shall be unlawful, void, or 
  83. for any reason unenforceable, then that provision shall be deemed 
  84. severable from this Agreement and shall not affect the validity and 
  85. enforceability of the remaining provisions of this Agreement. This 
  86. Agreement is governed by the laws of the Commonwealth of Virginia.
