Berkeley Systems, Inc. and Paramount Pictures grant you a non-exclusive, nontransferable license to use Star Trek«: The Screen Saver (the "Program") on one computer. You may install one copy of the Program onto the hard disk of one computer, and you may make one copy of the Program disk for backup purposes. These copies must include the Star Trek: The Screen Saver copyright notice.
The Program, including its graphics displays and its related documentation are copyrighted. You may not rent, distribute or transfer copies of the Program or documentation; make any copies of Program modules for use with other screen saver programs; or use the Program on more than one terminal of a network, on a multi-user computer, on a time-sharing system, on a service bureau, or an any other system on which the Program could be used by more than one person at a time.
This license is effective until terminated. You may terminate it at any time by destroying all copies of the Program. It will also terminate automatically if you fail to comply with any of the terms and conditions of the Agreement.
This Agreement constitutes the entire agreement and understanding between the parties and supersedes any prior agreements, representations, or understandings, whether oral or written, relating to the Program.
This Agreement shall be governed by the laws of the State of California.
Limited Warranties
Berkeley Systems, Inc. warrants that the manual and the original Program disks are free from physical defects in material and workmanship under normal use for a period of sixty days from the date of purchase. If during this warranty period you discover that either this manual or the Program disk contains a physical defect, return the defective item along with proof of purchase to Berkeley Systems and you will receive a replacement at no charge. This is your sole and exclusive remedy for breach of warranty.
THE WARRANTY SET FORTH ABOVE IS EXCLUSIVE AND IN LIEU OF ALL OTHERS, ORAL OR WRITTEN, EXPRESS OR IMPLIED.
BERKELEY SYSTEMS AND PARAMOUNT PICTURES MAKE NO WARRANTY OR REPRESENTATION, EXPRESS, IMPLIED OR STATUTORY WITH RESPECT TO THIS PROGRAM, ITS QUALITY, PERFORMANCE, MERCHANT ABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THIS PROGRAM IS SOLD "AS IS", AND YOU, THE LICENSEE, ARE ASSUMING THE ENTIRE RISK AS TO ITS QUALITY AND PERFORMANCE.
IN NO EVENT SHALL BERKELEY SYSTEMS OR PARAMOUNT PICTURES BE LIABLE FOR DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THE PROGRAM OR FROM ANY ERROR OR DEFECT IN THE PROGRAM OR ITS DOCUMENTATION, SUCH DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOSS OF PROFIT, LOSS OF PROGRAMS OR DATA, AND DAMAGE TO YOUR MONITOR. IN NO EVENT SHALL BERKELEY SYSTEMS' OR PARAMOUNT PICTURE'S LIABILITY EXCEED THE PRICE PAID FOR THE PROGRAM.
The above exclusions may not apply to you. This warranty provides you with specific legal rights. There may be other rights that you may have which vary from state to state.
Notice to Federal Government Customers
The Program is commercial computer software under Federal Acquisition regulations, and is provided only under the Restricted Rights of the Federal Acquisition Regulations applicable to commercial computer software provided at private expense. The use, duplication, or disclosure by the Government is subject to restrictions set forth in subdivision(c)(i)(ii) of the Rights in Technical Data and Computer Software clause at 252.227-7013.
