PLEASE READ THE TERMS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE PURCHASING OR USING THIS SOFTWARE BECAUSE PURCHASE AND USE OF THIS SOFTWARE WILL INDICATE YOUR ASSENT TO EACH TERM OF THIS LICENSE AGREEMENT. PHOENIX TECHNOLOGIES LTD. (PHOENIX) WILL LICENSE THE SOFTWARE TO YOU ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THIS LICENSED AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, THEN DO NOT PURCHASE OR USE THE SOFTWARE.
Standard Use Agreement
The software is owned by Phoenix and/or its suppliers, and is protected by United States copyright laws and international treaty provisions. You shall treat the software like any other copyright material.
You may:
* Use this software on any compatible computer, providing that you install the software on only one computer at a time.
* Use this software on a network or file server, providing that access to the software is limited to one user at a time, and that the user shall have the original copy of the software program diskettes and documentation in their possession at the time of usage.
* Transfer this software to another party by transferring the original copy of the software program diskettes and all applicable documentation, including the original of this Phoenix End-User Program License Agreement. You shall delete and/or destroy all other copies of the software and documentation. This transfer of possession terminates your license, and all associated benefits, with Phoenix.
* Make one copy of the software solely for backup or archival purposes or the right to transfer the software to a single hard disk drive, provided that you keep the original software program diskettes and accompanying documentation in your possession, solely for backup or archival purposes.
You may not:
* Use, copy, or transfer copies of this software and documentation except as provided for in this Phoenix End-User Program License Agreement, as set forth herein.
* Alter, merge, modify, or adapt this software in any way, including disassembling, decompiling, or reverse engineering the software.
* Loan, rent , lease or sublicense this software, or any copy of this software.
LIMITED WARRANTY
EXCEPT AS SPECIFICALLY PROVIDED HEREIN, PHOENIX DISCLAIMS ALL OTHER WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, WITH RESPECT TO THIS SOFTWARE OR DOCUMENTATION, INCLUDING THE QUALITY, PERFORMANCE, MERCHANTABILITY OR FITNESS OF THIS SOFTWARE OR DOCUMENTATION, FOR A PARTICULAR PURPOSE.
IN NO EVENT WILL PHOENIX BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION, EVEN IF PHOENIX IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL PHOENIX'S LIABILITY EXCEED THE PURCHASE PRICE PAID FOR THE SOFTWARE AND ACCOMPANYING DOCUMENTATION, NET ALL APPLICABLE TAXES AND DUTIES.
The warranty and remedies set forth above are exclusive, and in lieu of all other, oral or written, express or implied. No Phoenix dealer, distributor, agent or employee is authorized to make any modification or addition to this warranty. Some states do not allow the exclusion or limitation of liability for incidental or consequential damages, so the aforementioned limitation or exclusion may not apply.
GENERAL
The export of this product is restricted by applicable U.S. export egulations.
