  1.                       Liscense Agreement and Order Form

  4.       DavisWARE is Copyrighted by James R. Davis and is covered by US and
  5. International Copyright laws.  The author reserves all rights.
  6.  
  7. Liscense:
  8.  
  9.    You are granted a limited liscense to use DavisWARE for a thirty (30)
  10. day period for the purpose of evaluating it for your own use.  After thirty
  11. days, you are required to either register DavisWARE or stop using it. To
  12. continue using it is a violation of copyright laws and just not a nice
  13. thing to do..
  14.  
  15.    The Shareware version of any DavisWARE program is NOT crippled in any
  16. way. There are no missing features or timers.  The only differences between
  17. the registered and unregistered versions of DavisWARE programs are, the
  18. Shareware version places the word "UNREGISTERED" in the bulletin and
  19. displays the UNREGISTERED logo on the computer screen as part of the
  20. copyright notice. Depending on the program, a Shareware version of a
  21. DavisWARE program may contain an undocumented feature that will be unlocked
  22. when registration is received, but this doesn't happen very often.

  24. BBS Distribution:
  25.  
  26.    BBSs are granted a limited liscense to distribute DavisWARE in a
  27. compressed format.  The distributing BBS is not limited to the type of
  28. compression method used for distribution.  However, the BBS must follow the
  29. following guidelines:
  30.  
  31. 1. If any DavisWARE program is distributed in a ".ZIP" file, the BBS must do
  32.    it's best to preserve the "AV" that the DavisWARE program was compressed
  33.    with by the author.  If a BBS wishes to have a DavisWARE program sent to
  34.    them directly from the author, please contact the author and a copy will
  35.    be sent either by US Mail, or uploaded directly to the BBS.  The sole
  36.    exception to distribution of a DavisWARE program without the security
  37.    "AV" placed by the author is where a BBS uses a program to validate
  38.    their uploads that, as a part of validation, reZIP's the file for
  39.    maximum compression (not necessary since the distribution archive from
  40.    the author is created with maximum compression enabled).
  41.  
  42. 2. No BBS may, in re-ZIPing a DavisWARE program, add to the ".ZIP" their
  43.    own "AV" which does not belong to the author.
  44.  
  45. 3. No BBS is authorized to add any files to the archive which are not part
  46.    of the original DavisWARE program archive as distributed by the author.
  47.    The sole exception is where a BBS adds an ASCII text file (containing no
  48.    ANSI codes of any type) as an advertisement, and the filename for the
  49.    file has not and/or will not change, and the BBS does not "cycle"
  50.    filenames for the purpose of "fooling" upload checking programs from
  51.    other BBSs which remove such advertisements.

  53. 4. No user may be charged any additional fee just to download a DavisWARE
  54.    program from the BBS.
  55.  
  56. Shareware Vendor Distribution:
  57.  
  58.    This copyrighted software and its documentation is NOT PUBLIC DOMAIN.
  59. However, any DavisWARE program may be distributed at no charge, or for a
  60. charge not to exceed $12 US to cover shipping and media costs.  When
  61. secondarily distributed, a DavisWARE program must be in its original
  62. compressed form and accompanied by its full documentation.  The distributed
  63. software and documentation may not have been modified in any way. 
  64.  
  65.    No secondary distributor is authorized to "register" an individual copy
  66. of a DavisWARE program.  Registration fees may only be sent directly to the
  67. author as outlined in the manual on disk.  Note that the registration fee
  68. is exclusive of, and over and above any fees that may have been charged by
  69. a secondary distributor.
  70.  
  71.    A secondary distributor must notify it's customers that a DavisWARE
  72. program is a shareware program and that the fee payed by their customer
  73. does not include any fees owed the author for use of this program.
  74.  
  75.    A secondary distributor must notify the author of their intention to
  76. include this group of files in their distribution.  A secondary distributor
  77. may be granted exceptions to these conditions, only in writing from the
  78. original author.
  79.  
  80.    The author reserves the right to change any of these conditions without
  81. notice and any changes become retroactive.  Failure to abide by this
  82. liscense agreement may result in either Civil Lawsuit or Criminal charges
  83. being filed.

  88.    Registration:
  89.  
  90.       Once you have registered a DavisWARE program, you are eligible to
  91.       recieve all future versions of that DavisWARE program for no
  92.       additional upgrade fee beyond any necessary shipping charges, unless
  93.       deemed so by the author.
  94.  
  95.       Multi-node systems do not need to register one copy for each node,
  96.       instead, we charge just a $5 fee which covers from 2 to unlimited
  97.       number of nodes.
  98.  
  99.    Shipping and Handling:
  100.  
  101.       All orders REQUIRE a shipping and handling charge as shown below. 
  102.       These charges cover our costs in shipping your order and tracing
  103.       delivery problems.
  104.

  110.       Once your order has been recieved and processed, you will be mailed
  111.       a letter containing your serial number and instructions for using it
  112.       in your configuration file.
  113.  
  114.       Orders typically require 3 - 4 business days processing time before
  115.       shipment, and may take more or less depending on our order backlog.
  116.       US standard shipping is via UPS Ground, via US Priority Mail where
  117.       UPS delivery is impossible (PO Boxes, Alaska, Hawaii, and APO / FPO
  118.       addresses), and via First Class Mail for diskette-only orders.  US
  119.       2-day shipping is via UPS Blue Label.  All shipping outside the US is
  120.       via Air Mail.  Shipping time varies from 1 business day for UPS
  121.       Ground to New England, to 6 business days for UPS Ground to California,
  122.       to several weeks for countries outside the US where mail service
  123.       is slow.  Express shipping via UPS Red Label or Federal Express is
  124.       available; contact us for rates.

  126.    Payment Terms:

  128.       Personal checks may be subject to a bank clearance delay before
  129.       shipment.  All payments must be made in US funds and drawn on a US
  130.       bank; see below for more details on international orders.  There
  131.       is a $7 charge for all returned checks.

  133.    International Orders:

  135.       We are happy to accept orders from outside the US, but must require
  136.       payment in the correct form to avoid the exorbitant fees charged by
  137.       US and non-US banks for international check collections.

  139.       Acceptable Payment:

  141.           *  A check or money order in US funds and drawn on a US bank.
  142.              Checks which are not in US funds and drawn on a US bank must
  143.              unfortunately be returned to you, resulting in significant
  144.              delay in processing your order and additional expense to
  145.              you.
