1 By using or copying the enclosed software you are indicating your acceptance of the terms of this license. If you do not agree to the terms of this license, please return the product unopened to your place of purchase for a full refund.
2 GRANT OF LICENSE. NTP Software grants you the right to use one (1) copy of RAS Manager for Windows NT ("PRODUCT") solely for your or your company s own internal use. In addition to the specified quantity of copies, you may make one (1) additional copy as backup to the original. However, you may not cause the software to execute or be loaded into the active memory of more computers than the above specified quantity at any one time.
3 COPYRIGHT. The PRODUCT is owned by NTP SOFTWARE or its suppliers and is protected by United States copyright laws and international treaty provisions. Therefore, you must treat the PRODUCT like any other copyrighted material except that, as specified above, you may either: a.) make one copy of the PRODUCT solely for backup or archival purposes, or b.) transfer the PRODUCT to a single hard disk provided you keep the original solely for backup or archival purposes. You may not copy the DOCUMENTATION, if any, accompanying the PRODUCT.
4 OTHER RESTRICTIONS. You may not rent, lease, or otherwise allow access to the software without completely transferring the license and all rights to use the PRODUCT and any accompanying written materials ("DOCUMENTATION"). You may not reverse engineer, decompile, or disassemble the PRODUCT.
5 LIMITED WARRANTY. NTP SOFTWARE warrants that the original copy of the software will perform substantially as described in accordance with the accompanying written materials for a period of ninety (90) days from your date of purchase. Any and all warranties, expressed or implied, are limited to your first ninety (90) days of ownership.
6 CUSTOMER REMEDIES. NTP SOFTWARE s entire liability under this warranty shall be, at NTP SOFTWARE s option, either (a) the return of the purchase price of the PRODUCT, or (b) repair or replacement of the PRODUCT that does not meet NTP SOFTWARE s limited warranty. This limited warranty is void if the failure of the software has resulted from abuse, negligence, accident, or misuse of the PRODUCT. Any replacement product will be warranted under the terms of this limited warranty for the remainder of the term of this agreement or thirty (30) days, whichever is longer.
7 NO OTHER WARRANTIES. To the maximum extent allowed by law, NTP SOFTWARE disclaims all other warranties, either expressed or implied, including but not limited to warranties of merchantability and fitness for a particular purpose with respect to the PRODUCT and DOCUMENTATION.
8 NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL NTP SOFTWARE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT OR DOCUMENTATION, EVEN IF NTP SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9 U.S. GOVERNMENT RESTRICTED RIGHTS. The PRODUCT and DOCUMENTATION are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(i) and (2) of Commercial Computer Software -- Restricted Rights at 48 CFR 52.227-19, as applicable. 10 If you acquired this product in the United States, this Agreement is governed by the laws of the State of New Hampshire. If you acquired this product outside the United States, local law may apply.
