  1. SWAT Consulting Inc. SOFTWARE AGREEMENT

  3. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS,
  4. DO NOT INSTALL THE SOFTWARE.

  6. 1. USE
  7.  
  8. You  may use the Software, in the quantities purchased, 
  9. provided you abide by the terms and conditions of this
  10. Agreement.
  11.  
  12. FOR TRIAL USE:
  13.  
  14. You may evaluate the Software for a period of fifteen (15) days
  15. (the "Trial Period").  If you wish to continue using the
  16. Software, you must register the Software during the
  17. Trial Period in order for your continued use of the Software to
  18. be legal. Multiple Trial Periods are prohibited.
  19.  
  20. Software acquired for evaluation during a Trial Period is
  21. provided on an "AS IS" basis. SWAT Consulting makes no warranty,
  22. representation, promise or guarantee, either express or implied, 
  23. statutory or otherwise, with respect to the Software, the user
  24. documentation or any related technical support, including their
  25. quality, performance, merchantability or fitness for a particular
  26. purpose.  Some jurisdictions do not allow exclusions
  27. of an implied warranty, so this disclaimer may not apply to you
  28. and you may have other legal rights that vary by jurisdiction.

  30. 2. RESTRICTIONS

  32. You may not alter, merge, modify or adapt the Software in any
  33. way including reverse engineering, disassembling or decompiling.
  34. You may distribute the shareware Software freely as long as all
  35. accompanying files in the ZIP file remain intact.
  36. You may not sell, distribute, loan, rent, lease, license or
  37. otherwise transfer registered Software.

  40. 3.  INTELLECTUAL PROPERTY RIGHTS
  41.  
  42. All intellectual property rights in the Software and user
  43. documentation are owned by the author and are protected by United 
  44. States intellectual property laws (including patent, trademark and 
  45. copyright laws), other applicable intellectual property laws, and 
  46. international treaty provisions.  SWAT Consulting retains all rights
  47. not expressly granted.

  50. 4. WARRANTY

  52. SWAT Consulting makes no warranty, representation, promise or
  53. guarantee, either express or implied, statutory or otherwise, with 
  54. respect to the Software, the user documentation or any related 
  55. technical support, including their quality, performance, 
  56. merchantability or fitness for a particular purpose.

  58. The warranty and remedies set forth herein are exclusive and in
  59. lieu of all others, oral or written, express or implied.  This
  60. warranty gives you specific legal rights, and you may also have
  61. other rights which vary from state to state.

  63. 5. LIMITATION OF LIABILITY
  64.  
  65. In no event will SWAT Consulting be liable for (i) indirect,
  66. special, incidental, tort, economic, cover or consequential damages 
  67. arising out of the use of or inability to use SWAT Consulting's
  68. products or services, including, without limitation, damages or 
  69. costs relating to the loss of profits, business, goodwill, data 
  70. or computer programs, even if advised of the possibility of such 
  71. damages, or (ii) any claim that arose more than one (1) year prior 
  72. to the institution of suit thereon.  In no case shall SWAT Consulting's
  73. liability exceed the amount paid by you for the Software.
  74. The foregoing limitations shall not apply to claims relating to 
  75. death or personal injury which arise out of products deemed to be 
  76. consumer goods under applicable law.  Some states, provinces or 
  77. countries do not allow the exclusion or limitation of implied 
  78. warranties or limitation of liability for incidental or 
  79. consequential damages, so the above exclusion or limitation may 
  80. not apply to you.
