  2. BY COPYING, DISTRIBUTING, INSTALLING, OR USING THE TERABYTE, INC.
  3. ("TERABYTE") FREEWARE SOFTWARE PRODUCT WITH WHICH THIS LICENSE AGREEMENT
  4. WAS PROVIDED (THE "PRODUCT"), THE INDIVIDUAL OR ENTITY USING THE PRODUCT
  5. ("USER") IS CONSENTING TO BE BOUND BY AND IS BECOMING A PARTY TO THIS
  6. AGREEMENT. IF USER DOES NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT,
  7. USER MUST NOT COPY, DISTRIBUTE, INSTALL OR USE THE PRODUCT IN ANY MANOR.
  8. IF USER HAS RECEIVED A SIGNED LICENSE AGREEMENT FOR THIS PRODUCT DIRECTLY
  9. FROM TERABYTE THAT CONTAINS TERMS WHICH VARY FROM THE TERMS IN THIS 
  10. AGREEMENT, THEN THE SIGNED LICENSE AGREEMENT GOVERNS THE USE OF THE 
  11. PRODUCT.

  15. The Software is distributed as Freeware. You may use this version of the
  16. software, subject to the conditions below, on any number of computers for
  17. as long as you like. The software is NOT Public Domain software. You are
  18. allowed to freely distribute the software, but TeraByte, Inc. retains
  19. ownership and copyright of the software in its entirety. You may use
  20. and/or distribute the software only subject to the following conditions:

  22.    * You may only use the software as intended by TeraByte.

  24.    * You may not use the software to support any third party product 
  25.      without the express written consent of TeraByte.
  26.  
  27.    * You may not modify the program or documentation files in any way
  28.  
  29.    * You must include all the files that were in the original distribution

  31.    * You may not reverse engineer, decomplie, or otherwise reduce the
  32.      Software to a human perceivable form

  34.    * You may not sell the software or charge a distribution fee, except to
  35.      recover the media costs

  37.    * You understand and agree with this license and with the disclaimer of
  38.      warranty and the limitation of liability printed below

  40.    * The software may be bundled and distributed together with other 
  41.      software products but the same conditions apply

  43. Disclaimer of Warranty

  45. The software and related documentation are provided "as is", without
  46. warranty of any kind. TeraByte, Inc. disclaims all warranties, express or
  47. implied, including, but not limited to, the implied warranties of design,
  48. merchantability, fitness for a particular purpose. TeraByte, Inc. does not
  49. warrant that the functions contained in the software or documentation will
  50. meet your requirements, or that the operation of the software will be
  51. error-free, complete, or that defects in the software or documentation
  52. will be corrected.

  54. Limitation of Liability

  56. Under no circumstances shall TeraByte, Inc. be liable for any lost revenue
  57. or profits or any incidental, indirect, special, or consequential damages
  58. that result from the use or inability to use the Software or related
  59. products or documentation, even if TeraByte, Inc. has been advised of the
  60. possibility of such damages.

  62. Some states do not allow the limitation or exclusion of liability for
  63. incidental or consequential damages so the above limitation or exclusion
  64. may not apply to you. In no event shall TeraByte, Inc.'s total liability
  65. to you for all damages, losses, and causes of action, whether in contract,
  66. tort or otherwise, exceed the amount paid by you for the software.
