  7. LICENSE AGREEMENT AND WARRANTY DISCLAIMER

  9. You should carefully read the following terms and
  10. conditions before using this software. Use of this
  11. software indicates your acceptance of these terms
  12. and conditions.  If you do not agree with them, do
  13. not use the software.

  16. SHAREWARE VERSION LICENSE

  18. The Shareware Version is not free software.  If
  19. you are using the Shareware Version you are hereby
  20. licensed to use this software for evaluation
  21. purposes without charge for a period of 10 uses.
  22. If you use this software after the 10-use
  23. evaluation period a registration fee is due (see
  24. Ordering Information).

  26. If you are using the Shareware Version of the
  27. software you are also hereby licensed to: Make as
  28. many copies of the Shareware version of this
  29. software and documentation as you wish; Give exact
  30. copies of the original Shareware version to
  31. anyone; Distribute the Shareware version of the
  32. software and documentation in its unmodified form
  33. via electronic means.  There is no charge for any
  34. of the above.

  36. Unregistered use of Application Mover after the
  37. evaluation period is in violation of federal
  38. copyright laws.

  40. You may not decompile, disassemble, reverse
  41. engineer, or modify any version of Application
  42. Mover (shareware) in any manner.

  45. REGISTERED VERSION LICENSE
  46.  
  47. One registered copy of Application Mover may be
  48. dedicated to a single person who uses the software
  49. on one or more computers or workstations that are
  50. for their own exclusive use and for which they are
  51. the sole user.

  53. The purchase of a single user license specifically
  54. does not permit use of the program to modify,
  55. update, or search multiple workstations, directly
  56. or indirectly, via any means.  A single user
  57. license may not be made available in any form to
  58. multiple users or workstations.

  60. Licensing is not based on "concurrent" users.  If
  61. multiple workstations are to access the program in
  62. any form and for any length of time you must
  63. purchase licenses for the number of workstations
  64. that will access the program.  If you make the
  65. registered version of Application Mover available
  66. through a network and accessible by multiple users
  67. or workstations you are required to purchase
  68. licenses for the software covering all
  69. workstations that will access the software through
  70. the network. Special pricing is available for
  71. multiple licenses.  See Ordering Information for
  72. information on how to purchase (register).

  79. SPECIAL USE LICENSE FOR LARGE NETWORKS

  81. Special licensing is available for corporate &/or
  82. large networks. The purchase of a special use
  83. license allows you to use the program to inventory
  84. the number of workstations for which you purchased
  85. special use licenses for.  Unless otherwise noted
  86. at the time of your purchase, a workstation
  87. update/special use license specifically does not
  88. allow individual workstation users to access the
  89. program for interactive use.  Do not create
  90. desktop shortcuts or launchers that allow
  91. workstation users to access the program outside of
  92. the specific update routine for which you
  93. purchased the special use license.

  99. OWNERSHIP RIGHTS

  101. Funduc Software, Inc. owns and retains all
  102. copyrights, patents, trade secret rights,
  103. trademarks and intellectual property rights to
  104. this software. Registration &/or use of the
  105. software does not grant you any right to the
  106. intellectual property in the product.

  116. RESTRICTIONS

  118. You are prohibited by law from selling, renting,
  119. leasing, loaning, or donating the program or
  120. documentation in whole or in part without specific
  121. advance agreement between yourself and Funduc
  122. Software, Inc.  You are prohibited by law from
  123. redistributing the registered version of the
  124. program by any method or in any form except to the
  125. specific individuals for whom the software was
  126. purchased.  You are prohibited from decompiling,
  127. reverse engineering, disassembling, or otherwise
  128. reducing the program to human readable form for
  129. any purposes whatsoever.  You may not modify the
  130. program or documentation in any manner.  You are
  131. prohibited from permitting anyone else from
  132. undertaking any of the above actions.

  135. reverse engineer Application Mover (registered or
  136. shareware) in any manner.

  139. GOVERNING LAW

  141. This agreement shall be governed by the laws of
  142. the State of Michigan, United States.

  145. DISCLAIMER OF WARRANTY
  146.  
  147. This software and the accompanying files are sold
  148. "as is" and without warranties as to performance
  149. of merchantability or any other warranties whether
  150. expressed or implied.  In particular, there is no
  151. warranty for the string Replacing feature.
  152.  
  153. Good data processing procedure dictates that any
  154. program be thoroughly tested with non-critical
  155. data before relying on it. The user must assume
  156. the entire risk of using the program. Any
  157. liability of the seller will be limited
  158. exclusively to product replacement or refund of
  159. purchase price.
