  1. Netscape Communications Corporation BETA License Agreement

  3. THIS IS A LEGAL AGREEMENT TO WHICH YOU ARE CONSENTING TO BE
  4. BOUND. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS
  5. LICENSE, DO NOT USE THE SOFTWARE.

  7.     1.Netscape Communications Corporation ("Netscape") grants to you a
  8.        non-exclusive, non-sublicensable, license to use this Beta version of the
  9.        Netscape network navigator (the "Software"), in binary executable form
  10.        for evaluation and trial use purposes only. 
  11.  
  12.     2.NETSCAPE MAKES NO REPRESENTATIONS ABOUT THE
  13.        SUITABILITY OF THIS SOFTWARE OR ABOUT ANY CONTENT OR
  14.        INFORMATION MADE ACCESSIBLE BY THE SOFTWARE, FOR ANY
  15.        PURPOSE. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT
  16.        EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES
  17.        OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  18.        PURPOSE OR NONINFRINGEMENT. THIS SOFTWARE IS PROVIDED
  19.        GRATUITOUSLY AND, ACCORDINGLY, NETSCAPE SHALL NOT BE
  20.        LIABLE UNDER ANY THEORY OR ANY DAMAGES SUFFERED BY
  21.        YOU OR ANY USER OF THE SOFTWARE. NETSCAPE WILL NOT
  22.        SUPPORT THIS SOFTWARE AND WILL NOT ISSUE UPDATES TO
  23.        THIS SOFTWARE.

  25.     3.All content accessed through the Software is the property of the
  26.        applicable content owner and may be protected by applicable copyright
  27.        law. This License gives you no rights to such content.

  29.     4.While Netscape intends to distribute a commercial release of the
  30.        Software, Netscape reserves the right at any time not to release a
  31.        commercial release of the Software or, if released, to alter prices,
  32.        features, specifications, capabilities, functions, licensing terms, release
  33.        dates, general availability or other characteristics of the commercial
  34.        release.

  36.     5.Title, ownership rights, and intellectual property rights in and to the
  37.        Software shall remain in Netscape and/or its suppliers. You agree to
  38.        abide by the copyright law and all other applicable laws of the United
  39.        States including, but not limited to, export control laws. You acknowledge
  40.        that the Software in source code form remains a confidential trade secret
  41.        of Netscape and/or its suppliers and therefore you agree not to modify
  42.        the Software or attempt to decipher, decompile, disassemble or reverse
  43.        engineer the Software, except to the extent applicable laws specifically
  44.        prohibit such restriction.

  46.     6.Netscape may terminate this License at any time by delivering notice to
  47.        you and you may terminate this License at any time by destroying or
  48.        erasing your copy of the Software. Upon termination of this License, or
  49.        in any event within thirty (30) days following Netscape's release of a
  50.        commercial version of the Software, you agree to destroy or erase the
  51.        Software. In the event of termination, the following sections of this
  52.        License will survive: 2, 3, 4, 5, 6, 7 and 8. This License is personal to you
  53.        and you agree not to assign your rights herein. This License shall be
  54.        governed by and construed in accordance with the laws of the State of
  55.        California and, as to matters affecting copyrights, trademarks and
  56.        patents, by U.S. federal law. This License sets forth the entire agreement
  57.        between you and Netscape.

  59.     7.Use, duplication or disclosure by the Government is subject to
  60.        restrictions set forth in subparagraphs (a) through (d) of the Commercial
  61.        Computer-Restricted Rights clause at FAR 52.227-19 when applicable, or
  62.        in subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer
  63.        Software clause at DFARS 252.227-7013, and in similar clauses in the
  64.        NASA AR Supplement. Contractor/manufacturer is Netscape
  65.        Communications Corporation, 650 Castro Street, Suite 500, Mountain
  66.        View, CA 94041.

  68.     8.You may not download or otherwise export or reexport the Software or
  69.        any underlying information or technology except in full compliance with
  70.        all United States and other applicable laws and regulations. In particular,
  71.        but without limitation, none of the Software or underlying information
  72.        or technology may be downloaded or otherwise exported or reexported
  73.        (i) into (or to a national or resident of) Cuba, Haiti, Iraq, Libya,
  74.        Yugoslavia, North Korea, Iran, or Syria or (ii) to anyone on the US
  75.        Treasury Department's list of Specially Designated Nationals or the US
  76.        Commerce Department's Table of Deny Orders. By downloading the
  77.        Software, you are agreeing to the foregoing and you are representing
  78.        and warranting that you are not located in, under control of, or a
  79.        national or resident of any such country or on any such list.
