  73. dial-up connections, all of our modems are industrial grade 28.8 V.34 kbps

  78. connection. Instead of purchasing our Internet connectivity from third party

  80. arena. This basic principal reduces the number of hops that each of your
  81. dial-up packets has to travel before it is placed on the Internet backbone.

  83. For your Email needs, the dial-up accounts allows you to retrieve your mail
  84. using either POP3 or IMAP protocols. Some of the many existing programs that
  85. can be used to retrieve mail message using the POP3 and IMAP protocol are
  86. Eudora and PINE respectively. For our unlimited users we also provide SMTP for
  87. your Email needs.

  724. Please read this carefully. Failure to adhere to these terms may result in
  725. cancellation of your account. Similar restrictions are used by all Internet
  726. Service Providers.

  728. This Agreement is between Bay Area Internet Solutions, hereby referred to as
  729. Provider, and by Customer, as defined by the Bay Area Internet Solutions
  730. Dial-up Registration Form for Internet dial-up services. Whereby Customer
  731. agrees to abide by the following rules and conditions:
  732.  
  733. 1. Usage Policy
  734.  
  735. a. Customer understands that posting copyrighted materials, whether written,
  736. graphic, or in any other form, to any public site without permission from the
  737. author or creator is illegal and prohibited, and may be subject to prosecution
  738. and imprisonment.
  739.  
  740. b. Customers will not post advertisements to USENET newsgroups unless the
  741. newsgroup specifically states in its FAQ that advertisements are acceptable.
  742.  
  743. c. No unsolicited Email should be sent by Customer. Unsolicited Email is
  744. construed as Email sent to an individual or group where the recipient or
  745. recipients have not specifically requested information or a response. Email
  746. includes information of any kind, advertisements, literary works, graphics,
  747. voice and video files, and any other material that can be contained in current
  748. or future implementations of Email.
  749.  
  750. d. Customers will not use their Internet accounts to harass or abuse other
  751. members of the Internet community or for any unlawful purpose.
  752.  
  753. 2. Account Activation and Information
  754.  
  755. The Service starting Date is the day on which Provider activates the Customer's
  756. account. The setup fees and first month fee, as outlined in the Bay Area
  757. Internet Solutions Registration Form, are refundable if the Customer cancels
  758. within 7 calendar days of the Service starting Date.
  759.  
  760. Customer understands that the service period extends for 1 month and is
  761. automatically renewed unless terminated by the Customer or by the Provider. The
  762. Provider reserves the right to change its fees at any time, but must inform the
  763. Customer in writing at least 30 days prior to the new rate. Fee changes take
  764. effect at the time of renewal. Provider reservers the right to terminate any
  765. account in violation of any term of this agreement.
  766.  
  767. 3. No Warranties
  768.  
  769. Provider does not warrant any connection to, transmission over, or the results
  770. of the use of any network connection. Provider assumes no responsibility for
  771. any damage, loss, or expense suffered by the Customer, including but not
  772. limited to loss of data, delays, non-deliveries, mis-deliveries, or service
  773. interruption caused by Provider or Customer error, omission, or negligence.
  774.  
  775. Use of this service and any information obtained using this service is at the
  776. Customer's risk. Provider does not accept any responsibility of the accuracy
  777. of, quality of, or actions taken in response to the information obtained
  778. through its services.
  779.  
  780. 4. Service Use
  781.  
  782. Customer agrees to use this service only for lawful purposes. Any transmission
  783. of information in violation of any local, state, federal, or international
  784. regulations is prohibited. This includes, but is not limited to, obscene,
  785. copyrighted, or threatening material, and material protected by trade secrets.
  786. The Customer agrees to indemnify and hold harmless Provider for any claims that
  787. arise from the Customer's use of the service.
  788.  
  789. All services provided by the Customer either in part or in total using
  790. Provider's connection are subject to relevant local, state, federal, and
  791. international regulations. If Provider or other relevant authorities determine
  792. inappropriate usage of this service, Provider reserves the right to suspend or
  793. terminate the service immediately and without notification.
