This software including access to the SUPERFAMILY models, programs and data and any associated documentation whether electronic or printed (hereinafter called "SUPERFAMILY PACKAGE") is made available under a license agreement and may be used only in accordance with the terms of that agreement. This is a legal agreement between you (the Licensee), and MRC. The terms of the license are provided in the following pages.
Academic users are granted a free license upon completion of a registration procedure.
Corporate users are required to register and to pay an annual fee for access to the SUPERFAMILY PACKAGE. Details of fees and the procedure for registration and acceptance of the license terms is provided here.
By accessing the SUPERFAMILY PACKAGE itself or completing and sending the registration you demonstrate your agreement to the terms of this license and will become legally bound to the terms therein. Note that access to the SUPERFAMILY PACKAGE is recorded.
It should be emphasized that data provided in or produced by the SUPERFAMILY PACKAGE is by its very nature partly subjective. The MRC cannot offer advice on interpretation of the data within the SUPERFAMILY PACKAGE. Any assistance will be strictly limited to attempting to help if there are problems accessing the database with the SUPERFAMILY PACKAGE.
MRC makes no representation or warranties with respect to the SUPERFAMILY PACKAGE or any databases accessed through the SUPERFAMILY PACKAGE and specifically disclaims any implied warranties of merchantability and fitness for a particular purpose. MRC reserves the right to revise the software or SUPERFAMILY and to make changes therein fro time to time without obligation to notify any person or organisation of such revision or changes. While MRC will make every effort to ensure the accuracy of the SUPERFAMILY PACKAGE neither MRC nor its employees or agents may be held responsible for errors, omissions or other inaccuracies or any consequences thereof.
LICENSE TERMS
DEFINITIONS:
The term "SUPERFAMILY PACKAGE" as used in this Agreement means the hidden Markov model library, associated software, data and any associated documentation whether electronic or printed, together with any updates subsequently supplied by MRC.
This license agreement gives you (the Licensee) certain limited rights to use the SUPERFAMILY PACKAGE. The Licensee does not become the owner of, the MRC retains title to all of, the SUPERFAMILY PACKAGE. Licensee assumes responsibility for the selection and use of the SUPERFAMILY PACKAGE to achieve intended results, and for the installation, use and results obtained from the SUPERFAMILY PACKAGE. All rights not specifically granted in this License are expressly reserved by MRC.
GRANT OF LICENSE:
MRC grants the Licensee, a non-exclusive license and right to use the SUPERFAMILY PACKAGE for the term of the license, and to access any changes and updates during that time.
RESTRICTIONS:
If a free academic license was granted you may not use the SUPERFAMILY PACKAGE for financial gain, directly or otherwise. In this case a corporate license must be applied for.
Under no circumstances must the SUPERFAMILY PACKAGE be redistributed in part or whole to any party other than the Licensee. All access to the SUPERFAMILY PACKAGE must be directly from the MRC.
You may not include any part of the SUPERFAMILY PACKAGE in any product or package which is for sale, or which may be directly accessed by any party other than the Licensee.
WARRANTY:
EXCEPT AS STATED ABOVE, THE LICENSED PROGRAM IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY
KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL MRC BE LIABLE FOR LOSS
OF PROFIT, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS,
INCLUDING BUT NOT LIMITED TO SPECIAL INCIDENTAL CONSEQUENTIAL OR OTHER DAMAGES. LICENSEE WILL
NOT HOLD MRC OR ITS EMPLOYEES OR AGENTS RESPONSIBLE FOR ANY CONSEQUENCES ARISING FROM
LICENSEE'S USE OF THE PACKAGE. LICENSEE WILL HOLD HARMLESS MRC FOR ANY LOSSES OR DAMAGES OF
WHATSOEVER NATURE ARISING FROM LICENSEE'S USE OF THE SUPERFAMILY PACKAGE.
