  8. 1. This LICENSE AGREEMENT is between Endeavors Technology, Inc
  9. ("ETI"), having an office at 19700 Fairchild Road, Irvine, California,
  10. USA 92612 and the Individual or Organization ("Licensee") accessing
  11. and otherwise using this software in source or binary form and its
  12. associated documentation ("the Software").

  14. 2. Subject to the terms and conditions of this ETI Pippy License
  15. Agreement, ETI hereby grants Licensee a non-exclusive, royalty-free,
  16. world-wide license to reproduce, analyze, test, perform and/or display
  17. publicly, prepare derivative works, distribute, and otherwise use the
  18. Software alone or in any derivative version, provided, however, that
  19. the ETI Pippy License is retained in the Software, alone or in any
  20. derivative version prepared by Licensee.

  22. 3. ETI is making the Software available to Licensee on an "AS IS"
  23. basis.  ETI MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR
  24. IMPLIED.  BY WAY OF EXAMPLE, BUT NOT LIMITATION, ETI MAKES NO AND
  25. DISCLAIMS ANY REPRESENTATION OR WARRANTY OF MERCHANTABILITY OR FITNESS
  26. FOR ANY PARTICULAR PURPOSE OR THAT THE USE OF THE SOFTWARE WILL NOT
  27. INFRINGE ANY THIRD PARTY RIGHTS.

  29. 4. ETI SHALL NOT BE LIABLE TO LICENSEE OR ANY OTHER USERS OF THE
  30. SOFTWARE FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OR LOSS
  31. AS A RESULT OF USING, MODIFYING OR DISTRIBUTING THE SOFTWARE, OR ANY
  32. DERIVATIVE THEREOF, EVEN IF ADVISED OF THE POSSIBILITY THEREOF.

  34. 5. This License Agreement will automatically terminate upon a material
  35. breach of its terms and conditions.

  37. 6. This License Agreement shall be governed by and interpreted in all
  38. respects by the law of the State of California, excluding conflict of
  39. law provisions.  Nothing in this License Agreement shall be deemed to
  40. create any relationship of agency, partnership, or joint venture
  41. between ETI and Licensee.  This License Agreement does not grant
  42. permission to use ETI trademarks or trade names in a trademark sense
  43. to endorse or promote products or services of Licensee, or any third
  44. party.

  46. 7. By copying, installing or otherwise using the software, Licensee
  47. agrees to be bound by the terms and conditions of this License
  48. Agreement.
