  15. IMPORTANT:  CAREFULLY READ THIS LICENSE BEFORE USING THIS PRODUCT. 
  16. INSTALLING, COPYING, OR OTHERWISE USING THIS PRODUCT INDICATES YOUR
  17. ACKNOWLEDGMENT THAT YOU HAVE READ THIS LICENSE  AND AGREE TO BE BOUND
  18. BY AND COMPLY WITH ITS TERMS.  IF YOU DO NOT AGREE, RETURN THE
  19. COMPLETE PRODUCT TO COREL CUSTOMER SERVICE, 1600 CARLING AVENUE,
  20. OTTAWA, ONTARIO, CANADA, K1Z 8R7, WITHIN 10 DAYS OF THE DATE YOU
  21. ACQUIRED IT FOR A FULL REFUND.  THIS LICENSE AGREEMENT IS YOUR PROOF
  22. OF LICENSE.  PLEASE TREAT IT AS VALUABLE PROPERTY.
  23.  
  24. A. LICENSE:  
  25. COREL ("we" or "us") provides you with storage media containing a
  26. computer program, computer software, including its code, objects
  27. including their API's as well as any images, photographs, templates,
  28. animations, video, audio, music, text and "applets" incorporated into
  29. the software, the accompanying printed materials, a License, and
  30. "online" or electronic documentation (together called the "Product")
  31. and we grant you a license to use the Product in accordance with the
  32. terms of this License.  Any supplemental software code and supporting
  33. materials provided to you as part of support services provided by
  34. COREL for the Product shall be considered part of the Product and
  35. subject to the terms and conditions of this License.  The copyright
  36. and all other rights to the Product shall remain with us or our
  37. licensors.  You must reproduce any copyright or other notice marked
  38. on the Product on all copies you make.
  39.  
  40. B. YOU MAY:  
  41. 1. install and use one copy of the Product on a single computer or
  42. network.  This copy is to be used by only a single user at a time. 
  43. If you wish to use the Product for more users, you will need an
  44. additional license for each user.
  45. 2. make one copy of the Product for archive or backup purposes. 
  46. 3. install and use one copy of the Product on a single computer. The
  47. primary user of the computer on which the Product is installed may
  48. install the Product for his or her exclusive use on a single portable
  49. computer.
  50. 4. if this Product includes Clipart and/or Photo Images, use the
  51. Clipart and or Photo Images only if you comply with the terms set out
  52. in the Corel Guidelines for the Use of Clipart and Stock Photo Images
  53. below.
  54. 5. transfer the Product to someone else only if you assign all of
  55. your rights under this License, cease all use of the Product, erase
  56. or destroy any copy (including the hard disk copy) made in support of
  57. your use of the Product, and ensure that the person to whom you wish
  58. to transfer the Product agrees to the terms of this License.
  59. 6. if you have purchased this Product as an upgrade of either a Corel
  60. product or another vendor's product, you may continue to use your
  61. upgraded product with this Product.  If you transfer this Product,
  62. you must either transfer the upgraded product at the same time you
  63. transfer the Product or destroy the upgraded product at the same time
  64. you transfer the Product.  If the Product you have purchased is an
  65. upgrade of a Corel product, you now may use that upgraded product
  66. only in accordance with this License.
  67.  
  68. NOTE:     
  69. Corel products that provide PDF and/or TIFF-LZW and/or GIF and/or
  70. Postscript-LZW and/or LZW graphics capability utilize technology
  71. covered by U.S. Patent No. 4,558,302, and all foreign counterparts
  72. ("Unisys Patent").  The license granted to You hereunder permits you
  73. to use the Unisys Patent in conjunction with your use of this Product
  74. only.  Use of any other product or the performance of any other
  75. activity involving the compression/decompression technology covered
  76. by the Unisys Patent requires a separate license from Unisys
  77. Corporation.
  78.  
  79. C. YOU MAY NOT:  
  80. 1. use the Product or make copies of it except as permitted in this
  81. License. 
  82. 2. translate, reverse engineer, decompile, or disassemble the Product
  83. except to the extent the foregoing restriction is expressly
  84. prohibited by applicable law.
  85. 3. rent, lease, assign, or transfer the Product except as set out in
  86. paragraph B above.
  87. 4. modify the Product or merge all or any part of the Product with
  88. another program.
  89. 5. redistribute the fonts or sound files included with the Product
  90. 6. separate the component parts of the Product for use on more than
  91. one computer.
  92.  
  93. D. TERM:  
  94. This license shall remain in effect only for so long as you are in
  95. compliance with the terms and conditions of this agreement. This
  96. license will terminate if you fail to comply with any of its terms or
  97. conditions.  You agree, upon termination, to destroy all copies of
  98. the Product.  The Limitations of Warranties and Liability set out
  99. below shall continue in force even after any termination.
  100.  
  101. E. WARRANTY: 
  102. WE WARRANT THAT THE STORAGE MEDIA IN THIS PRODUCT WILL BE FREE FROM
  103. DEFECT IN MATERIALS AND WORKMANSHIP FOR NINETY (90) DAYS FROM THE
  104. DATE YOU ACQUIRE IT.  IF SUCH A DEFECT OCCURS, RETURN THE MEDIA TO US
  105. AT, COREL CUSTOMER SERVICE, 1600 CARLING AVENUE, OTTAWA, ONTARIO,
  106. CANADA, K1Z 8R7, AND WE WILL REPLACE IT FREE OF CHARGE.  THIS REMEDY
  107. IS YOUR EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY.  IT GIVES YOU
  108. CERTAIN RIGHTS AND YOU MAY HAVE OTHER LEGISLATED RIGHTS WHICH MAY
  109. VARY FROM JURISDICTION TO JURISDICTION.

  112. F. LIMITATION OF WARRANTIES AND LIABILITY:   
  113. EXCEPT FOR THE EXPRESS WARRANTY ABOVE , THE PRODUCT IS PROVIDED ON AN
  114. "AS IS" BASIS, WITHOUT ANY OTHER WARRANTIES OR CONDITIONS, EXPRESS OR
  115. IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE
  116. QUALITY, SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A
  117. PARTICULAR PURPOSE, OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE,
  118. COURSE OF DEALING OR OTHERWISE.  THE ENTIRE RISK AS TO THE RESULTS
  119. AND PERFORMANCE OF THE PRODUCT IS ASSUMED BY YOU.  NEITHER WE NOR OUR
  120. DEALERS OR SUPPLIERS SHALL HAVE ANY LIABILITY TO YOU OR ANY OTHER
  121. PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR
  122. CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS
  123. OF REVENUE OR PROFIT, LOST OR DAMAGED DATA OR OTHER COMMERCIAL OR
  124. ECONOMIC LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF
  125. SUCH DAMAGES, OR THEY ARE FORESEEABLE.  WE ARE ALSO NOT RESPONSIBLE
  126. FOR CLAIMS BY A THIRD PARTY.  OUR MAXIMUM AGGREGATE LIABILITY TO YOU
  127. AND THAT OF OUR DEALERS AND SUPPLIERS SHALL NOT EXCEED THE AMOUNT
  128. PAID BY YOU FOR THE PRODUCT.  THE LIMITATIONS IN THIS SECTION SHALL
  129. APPLY WHETHER OR NOT THE ALLEGED BREACH OR DEFAULT IS A BREACH OF A
  130. FUNDAMENTAL CONDITION OR TERM OR A FUNDAMENTAL BREACH.  SOME
  131. STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
  132. LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE
  133. LIMITATION MAY NOT APPLY TO YOU.
  134.  
  135. G. U.S. GOVERNMENT RIGHTS: 
  136. With respect to any acquisition of the Product by or for any unit or
  137. agency of the United States Government (the "Government"), the
  138. Product shall be classified as "commercial computer software", as
  139. that term is defined in the applicable provisions of the Federal
  140. Acquisition Regulation (the "FAR") and supplements thereto, including
  141. the Department of Defense (DoD) FAR Supplement (the "DFARS").  The
  142. Product was developed entirely at private expense, and no part of the
  143. Product was first produced in the performance of a Government
  144. contract.  If the Product  is supplied for use by DoD, the Product 
  145. is delivered subject to the terms of this Agreement and either (i) in
  146. accordance with DFARS 227.7202-1(a) and 227.7202-3(a), or (ii) with
  147. restricted rights in accordance with DFARS 252-227-7013
  148. (c)(1)(ii)(OCT 1988), as applicable. If the Product is supplied for
  149. use by a Federal agency other than DoD, the Product  is restricted
  150. computer software delivered subject to the terms of this Agreement
  151. and (i) FAR 12.212(a); (ii) FAR 52.227-19; or (iii) FAR 52.227-14(ALT
  152. III), as applicable.  The contractor/manufacturer is Corel
  153. Corporation Limited, Europa House, 3rd Floor, Harcourt Street, Dublin
  154. 2, Ireland.
  155.  
  156. H. EXPORT CONTROLS:  
  157. If the Product is identified as a  not-for-export product (for
  158. example, on the box, media or in the installation process), then,
  159. unless you have exemption from the United States Department of
  160. Commerce or other regulatory authority as designated from time to
  161. time the following applies:  EXCEPT FOR EXPORT TO CANADA FOR USE IN
  162. CANADA BY CANADIAN CITIZENS, THE PRODUCT MAY NOT BE EXPORTED OUTSIDE
  163. OF THE UNITED STATES OR TO ANY FOREIGN ENTITY OR "FOREIGN PERSON" AS
  164. DEFINED BY THE U.S. GOVERNMENT REGULATIONS, INCLUDING WITHOUT
  165. LIMITATION, ANYONE WHO IS NOT A CITIZEN, NATIONAL OR LAWFUL PERMANENT
  166. RESIDENT OF THE UNITED STATES. BY AGREEING TO THE TERMS OF THIS
  167. LICENSE YOU ARE WARRANTING TO COREL THAT YOU ARE NOT A "FOREIGN
  168. PERSON" OR UNDER THE CONTROL OF A "FOREIGN PERSON".
  169.  
  170. I. GENERAL:  
  171. This License is the entire agreement between us, superseding any
  172. other agreement or discussions, oral or written, and may not be
  173. changed except by a signed agreement. This License shall be governed
  174. by and construed  in accordance with the laws of the Province of
  175. Ontario, Canada for product purchased in Canada and by the laws of
  176. the Republic of Ireland for product purchased outside of Canada,
  177. excluding that body of law applicable to choice of law and excluding
  178. the United Nations Convention on Contracts for the International Sale
  179. of Goods and any legislation implementing such Convention, if
  180. otherwise applicable. If any provision of this License is declared by
  181. a Court of competent jurisdiction to be invalid, illegal, or
  182. unenforceable, such a provision shall be severed from the License and
  183. the other provisions shall remain in full force and effect. The
  184. parties have requested that this Agreement and all documents
  185. contemplated hereby be drawn up in English. Les parties aux prΘsentes

  189.  
  190. COREL GUIDELINES FOR THE USE OF 
  191. CLIPART AND STOCK PHOTO IMAGES
  192.  
  193. Corel products contain numerous clipart and photo images
  194. (collectively referred to as the "Images")  which are either owned by
  195. Corel or licensed from a third-party.  As a user of Corel products
  196. you are free to use, modify and publish the Images as you wish
  197. subject to the restrictions set out below.  If you are uncertain as
  198. to whether your intended use is in compliance with the Guidelines set
  199. out below, we recommend that you seek the advice of your own attorney
  200. or legal counsel.  Corel will not provide you with an opinion as to
  201. whether your use is in compliance with these Guidelines.
  202.  
  203.  
  204. A.   YOU MAY, subject to any restrictions set out below:
  205.  
  206. 1.   incorporate any Image(s) into your own original work and
  207. publish, display and distribute your work in any media; provided you
  208. include a copyright notice in your work reflecting on the copyright
  209. ownership of both you and Corel as follows:
  210.  
  211.      "Copyright   19__ [your name] and its licensors. All rights
  212. reserved."
  213.  
  214.      You may not, however, resell, sublicense or otherwise make
  215. available the Image(s) for use or distribution separately or detached
  216. from a product or web page.   For example, the Image(s) may be used
  217. as  part of a web page design, but may not be made available for
  218. downloading separately or in a format designed or intended for
  219. permanent storage or re-use by others.  Similarly, clients may be
  220. provided with copies of the Image(s) (including digital files) as an
  221. integral part of a work product, but may not be provided with the
  222. Image(s) or permitted to use the Image(s) separately or as part of
  223. any other product;
  224. 2.   make one (1) copy of the Image(s) for backup or archival
  225. purposes.
  226.  
  227. B.  YOU MAY NOT
  228.  
  229. 1.   create scandalous, obscene, defamatory or immoral works using
  230. the Image(s) nor use the Image(s) for any other purpose which is
  231. prohibited by law;
  232. 2.   use or permit the use of the Image(s) or any part thereof as a
  233. trademark or service mark, or claim any proprietary rights of any
  234. sort in the Image(s) or any part thereof;
  235. 3.   use any of the Images related to identifiable individuals or
  236. entities for any commercial purpose or in a manner which suggests
  237. their association with or endorsement of any product or service;
  238. 4.   use the Image(s) in electronic format, on-line or in multimedia
  239. applications unless the Image(s) are incorporated for viewing
  240. purposes only and no permission is given to download and/or save the
  241. Image(s) for any reason.
  242. 5.   rent, lease, sublicense or lend the Image(s), or a copy thereof,
  243. to another person or legal entity.  You may, however, transfer all
  244. your license to use the Image(s) to another person or legal entity,
  245. provided that (i) you transfer the Image(s) and this License,
  246. including all copies (except copies incorporated into your work
  247. product as permitted under this License), to such person or entity,
  248. (ii) that you retain no copies, including copies stored on a computer
  249. or other storage device, and (iii) the receiving party agrees to be
  250. bound by the terms and conditions of this License;
  251. 6.   use any Image(s) except as expressly permitted by this License.
  252.  
  253. Government Crests, Seals and other Insignia
  254.  
  255. The national and municipal insignia contained in this product are
  256. protected by various laws against misuse.  Generally speaking, all
  257. logos, insignia, patches, seals, flags and coats of arms are for
  258. official use only.  It is your responsibility to obey all national
  259. and international laws regulating display of the insignia, seals,
  260. flags and coats of arms contained herein.

  264. SDK ADDENDUM TO THE GENERAL LICENSE AGREEMENT
  265.  
  266. IF THIS PRODUCT CONTAINS A COREL SOFTWARE DEVELOPER'S TOOLKIT
  267. ("SDK"), YOUR USE OF THE SDK PORTION OF THE PRODUCT IS GOVERNED BY
  268. THE TERMS OF THE GENERAL LICENSE AGREEMENT AS MODIFIED BY THE TERMS
  269. OF THIS SDK ADDENDUM TO THE GENERAL LICENSE AGREEMENT.  IN THE EVENT
  270. OF ANY CONFLICT BETWEEN THE TERMS OF THE GENERAL LICENSE AGREEMENT
  271. AND THIS SDK ADDENDUM, THE TERMS OF THIS SDK ADDENDUM TO THE GENERAL
  272. LICENSE AGREEMENT SHALL GOVERN.
  273.  
  274. It is Corel's intention in designing the Software Developer's Kit to
  275. make it compatible with other versions of the Software Developer's
  276. Kit. However, since it is constantly being modified and reorganized,
  277. with certain capabilities added to or eliminated from any particular
  278. version or product, Corel makes no representations or warranties
  279. concerning compatibility with other versions or products.
  280.  
  281. You are solely responsible for determining the usefulness of the
  282. Software Developer's Kit for your particular purpose. The Software
  283. Developer's Kit is provided to software developers with the
  284. expectation that the developers are capable of writing and debugging
  285. their own programs; Corel does not assume any support obligations
  286. with respect to the Software Developer's Kit or the use thereof.  Any
  287. research, development, or evaluations you perform is done entirely at
  288. your own risk.
  289.  
  290. YOU MAY: 
  291. 1. use the SDK solely for the purpose of developing, manufacturing,
  292. marketing and supporting one or more applications software package(s)
  293. ("Software Application Product").
  294. 2. reproduce and sublicense the software program files included in
  295. the SDK's 'Redistributables' folder ("SDK files"), provided the files
  296. are in executable format and incorporated into a Software Application
  297. Product developed by you. Any sublicense of the SDK files shall be
  298. granted solely for the use of these SDK files in connection with and
  299. as a sublicensed part of a Software Application Product for any
  300. support, service, upgrades or other assistance.

  302. YOU MAY NOT: 
  303. 1. remove or alter any copyright notice, trademark, or other
  304. proprietary rights notice placed by Corel on the SDK or any portion
  305. thereof.
  306.  
  307. INDEMNIFICATION:  You agree to indemnify and hold Corel harmless from
  308. and against any and all costs,  liabilities, claims, or demands
  309. (including reasonable attorney's fees and expenses of any kind
  310. whatsoever) that arise or result from the use, reproduction or
  311. distribution of your Software Application Product, documentation, or
  312. promotional or sales materials.
  313.  
  314. COREL TRADEMARKS AND TRADENAMES:  You may not refer to Corel or
  315. include any Corel trademarks in or on any material except for the
  316. sole purpose of stating that a Software Application Product may be
  317. utilized in connection with the specific Corel software product.  In
  318. the event you refer to Corel or include the trademarks in or on any
  319. program materials or any packaging, marketing, or advertising
  320. materials, the trade name or trademarks must be accompanied with the
  321. following footnote disclaimer printed in a clearly legible manner on
  322. the same page in no smaller than ten-point type:
  323.  
  324. "This product is not manufactured, approved, or supported by Corel
  325. Corporation or Corel Corporation Limited."
