  3. NAME
  4.        bk bkl - display free use BitKeeper license
  5.  
  6. LICENSE
  7.                BitKeeper License version August-18-2003

  9.        1.  DEFINITIONS
  10.  
  11.        BKL:  This  license in its entirety, also known as the BitKeeper
  12.              License.
  13.  
  14.        You: The licensee of the BitKeeper Software.
  15.  
  16.        BitMover: The licensor of the BitKeeper Software.
  17.  
  18.        BitKeeper Software: The complete set of executable programs  and
  19.              any  accompanying  files,  such as documentation, known as
  20.              the BitKeeper Software.  The set  of  programs  and  files
  21.              must  include  all  files and programs distributed by Bit-
  22.              Mover as part of the BitKeeper Software.
  23.  
  24.        BitKeeper Package: A set of files managed by the same  BitKeeper
  25.              ChangeSet  file.   There  may be multiple instances of the
  26.              package; each instance is called a repository.
  27.  
  28.        Single user BitKeeper Packages: One or more  BitKeeper  Packages
  29.              wherein all changes to all files are made by the same per-
  30.              son and the total number of unique  files  over  all  Bit-
  31.              Keeper Packages does not exceed 1000.
  32.  
  33.        Metadata: Information about the data managed  by  the  BitKeeper
  34.              Software in a BitKeeper Package, such as
  35.  
  36.              + The ChangeSet file;
  37.  
  38.              + The  messages  which  annotate modifications of the data
  39.                (also known as check  in  comments,  ChangeLog  entries,
  40.                and/or log messages);
  41.  
  42.              + All  infrastructure  files contained below the top level
  43.                BitKeeper directory in a BitKeeper Package.   User  data
  44.                files,  i.e.,  files  contained in the BitKeeper/deleted
  45.                directories are explicitly excluded.
  46.  
  47.        Open Logging: The transmission of Metadata about the  data  man-
  48.              aged by the BitKeeper Software, to a functioning Open Log-
  49.              ging server in the openlogging.org domain (or an  alterna-
  50.              tive   domain  as  posted  on  www.bitkeeper.com/logging).
  51.              Examples of such collected  information  may  be  seen  at
  52.              http://www.openlogging.org.
  53.  
  54.        2.  LICENSE GRANTS
  55.  
  56.        Licensees  may  install  and  use the BitKeeper Software for its
  57.        intended purpose.
  58.  
  59.        3.  LICENSEE OBLIGATIONS
  60.  
  61.        (a)  Maintaining Open Logging Feature: You hereby  warrant  that
  62.             You will not take any action to disable or otherwise inter-
  63.             fere with the Open Logging feature of the  BitKeeper  Soft-
  64.             ware.   You hereby warrant that You will take any necessary
  65.             actions to ensure that the BitKeeper Software  successfully
  66.             transmits  the Metadata to an Open Logging server within 21
  67.             days of the creation of said Metadata.  By transmitting the
  68.             Metadata  to  an Open Logging server, You hereby grant Bit-
  69.             Mover, or any other operator of  an  Open  Logging  server,
  70.             permission  to republish the Metadata sent by the BitKeeper
  71.             Software to the Open Logging server.
  72.  
  73.        (b)  Accessing Others' BitKeeper Package: You may only  use  the
  74.             BitKeeper Software to access a BitKeeper Package created by
  75.             BitMover or third parties if You comply with the license of
  76.             the  BitKeeper  Package,  which  can  be  found at the Bit-
  77.             Keeper/etc/REPO_LICENSE file within the  BitKeeper  Package
  78.             and/or by running bk repo_license.
  79.  
  80.        (c)  Maintaining  Open Source: It is the intent of BitMover that
  81.             Your use of BitKeeper under this license is for the purpose
  82.             of maintaining Open Source.  By accepting this license, You
  83.             agree that You are prepared  to  demonstrate  Your  confor-
  84.             mance, at the request of BitMover, by making your BitKeeper
  85.             repositories publicly available via the BitKeeper  protocol
  86.             within 15 days from the time of such request.  In the event
  87.             that You do not wish to make  BitKeeper  repositories  pub-
  88.             licly  available,  You have 15 days in which to negotiate a
  89.             waiver, convert said repositories to closed use,  or  cease
  90.             use of said repositories.
  91.  
  92.        (d)  No  free  use  for  competitors:  Notwithstanding any other
  93.             terms in this License, this License is not available to You
  94.             if  You and/or your employer develop, produce, sell, and/or
  95.             resell a product which contains substantially similar capa-
  96.             bilities  of  the BitKeeper Software, or, in the reasonable
  97.             opinion of BitMover, competes with the BitKeeper  Software.
  98.  
  99.        (e)  No  combination  with  competing products: Inclusion of the
  100.             BitKeeper Software for use with a  system  having  substan-
  101.             tially  similar  capabilities  of  the  BitKeeper  Software
  102.             requires prior written permission from BitMover.
  103.  
  104.        (f)  Staying current: This license is terminated  in  the  event
  105.             there  is a new release of the BitKeeper Software which has
  106.             associated regression tests and said regression tests would
  107.             not  be  passed  by this version of the BitKeeper Software.
  108.             This license is terminated in the  event  there  is  a  new
  109.            release  of  the  BitKeeper  Software  which  contains  any
  110.             changes to any part of the licensing  functions,  including
  111.             but not limited to Open Logging.
  112.  
  113.        (g)  No  reverse  engineering:  You may not yourself and may not
  114.             permit or enable anyone to: (i)  modify  or  translate  the
  115.             Software;  (ii) reverse engineer, decompile, or disassemble
  116.             the Software or otherwise reduce the  Software  to  a  form
  117.             understandable   by  humans,  except  to  the  extent  this
  118.             restriction  is  expressly  prohibited  by  applicable  law
  119.             notwithstanding this limitation; or (iii) provide access to
  120.             the metadata created and managed by BitKeeper to any person
  121.             or  entity which is not licensed to use the BitKeeper Soft-
  122.             ware.
  123.  
  124.        (h)  Public reference: By  using  the  BitKeeper  Software,  You
  125.             agree to the public use of your name and/or your companies'
  126.             name as a user of the BitKeeper Software.
  127.  
  128.        4.  NON-CONFORMING USE
  129.  
  130.        4.1.  Single user packages
  131.  
  132.        For  single  user  BitKeeper Packages, Open Logging is optional.
  133.        The total number of  allowed  single  user  files  is  1000  per
  134.        licensee.
  135.  
  136.        4.2.  Closed Use
  137.  
  138.        Closed use is the use of the BitKeeper Software without partici-
  139.        pating  in  BKL  licensing  restrictions  such  as Open Logging.
  140.        Closed use of the BitKeeper Software requires that You (or  your
  141.        organization)  purchase closed use licenses for all users of the
  142.        BitKeeper Software within your organization.  This license,  the
  143.        BKL,  does  not  convey authority to make closed use of the Bit-
  144.        Keeper Software.
  145.  
  146.        4.3.  Logging Waivers
  147.  
  148.        Certain sites which do not wish to participate in Open  Logging,
  149.        such  as  educational or research institutes, may apply for, and
  150.        may be granted, a written  waiver  from  BitMover,  Inc.   After
  151.        applying  for  a written waiver, such an institution may use the
  152.        BitKeeper Software without Open Logging, for up to 90  days,  or
  153.        until  a  response  is  received  from BitMover, Inc., whichever
  154.        comes first.  Should BitMover not grant your waiver request, You
  155.        have  the option of converting to Open Logging, immediately ter-
  156.        minating your use of the BitKeeper Software or  continuing  your
  157.        use after purchasing closed use license[s].
  158.  
  159.        4.4.  Damages
  160.  
  161.        Use  and/or  copying of modified versions of the BitKeeper Soft-
  162.        ware is a violation of copyrights held by BitMover on  the  Bit-
  163.        Keeper  Software.   Use  of  the  BitKeeper  Software  without a
  164.       license is a violation of copyrights held  by  BitMover  on  the
  165.        BitKeeper  Software.  Damages for copyright infringement are the
  166.        greater of actual damages or statutory damages, which  are  cur-
  167.        rently up to $150,000 per infringement.
  168.  
  169.        This  license is not available to You if You and/or your company
  170.        have any unresolved copyright disputes with BitMover.
  171.  
  172.        5.  DISCLAIMER OF WARRANTY
  173.  
  174.        COVERED CODE IS PROVIDED UNDER THIS  LICENSE  ON  AN  ``AS  IS''
  175.        BASIS,  WITHOUT  WARRANTY OR INDEMNIFICATION OF ANY KIND, EITHER
  176.        EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION,  WARRANTIES
  177.        OR  INDEMNITIES CONCERNING INTELLECTUAL PROPERTIES (E.G. PATENTS
  178.        OR COPYRIGHTS), WARRANTIES THAT THE  COVERED  CODE  IS  FREE  OF
  179.        DEFECTS,  MERCHANTABLE,  FIT  FOR  A  PARTICULAR PURPOSE OR NON-
  180.        INFRINGING.  SHOULD ANY  PORTION  OF  BITKEEPER  SOFTWARE  PROVE
  181.        DEFECTIVE  IN  ANY RESPECT, YOU ASSUME THE COST OF ANY RESULTING
  182.        DAMAGES, NECESSARY SERVICING, REPAIR OR  CORRECTION.  THIS  DIS-
  183.        CLAIMER  OF  WARRANTY  CONSTITUTES  AN  ESSENTIAL  PART  OF THIS
  184.        LICENSE. NO USE OF BITKEEPER SOFTWARE  IS  AUTHORIZED  HEREUNDER
  185.        EXCEPT SUBJECT TO THIS DISCLAIMER.

  187.        6.  TERMINATION
  188.  
  189.        + This  License  and the rights granted hereunder will terminate
  190.          automatically if You fail to comply with terms herein.  Provi-
  191.          sions  which,  by their nature, should remain in effect beyond
  192.          the termination of this License shall survive.
  193.  
  194.        + If any of the licensing requirements, such  as  Open  Logging,
  195.          are found to be unenforceable, then this license automatically
  196.          terminates unless You continue  to  comply  with  all  of  the
  197.          licensing requirements.
  198.  
  199.        + Should  You  or  your organization choose to institute patent,
  200.          copyright, and/or  intellectual  property  litigation  against
  201.          BitMover,  Inc.  with  respect to the BitKeeper Software, then
  202.          this License and the rights granted hereunder  will  terminate
  203.          automatically as of the date such litigation is filed.
  204.  
  205.        + If  this License is terminated for any reason, You must delete
  206.          all copies of the BitKeeper Software and cease using the  Bit-
  207.          Keeper Software.
  208.  
  209.        7.  LIMITATION OF LIABILITY
  210.  
  211.        TO THE FULL EXTENT ALLOWED BY APPLICABLE LAW, BITMOVER'S LIABIL-
  212.        ITY TO YOU FOR CLAIMS RELATING  TO  THIS  LICENSE,  WHETHER  FOR
  213.        BREACH  OR  IN  TORT,  SHALL  BE  LIMITED TO ONE HUNDRED PERCENT
  214.        (100%) OF THE AMOUNT HAVING THEN ACTUALLY BEEN PAID  BY  YOU  TO
  215.        BITMOVER  FOR  ALL  COPIES  LICENSED HEREUNDER OF THE PARTICULAR
  216.        ITEMS GIVING RISE TO SUCH CLAIM, IF ANY.
  217.  
  218.        IN NO EVENT WILL BITMOVER BE LIABLE FOR ANY INDIRECT,  PUNITIVE,
  219.       SPECIAL,  INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH
  220.        OR ARISING OUT OF THIS LICENSE (INCLUDING,  WITHOUT  LIMITATION,
  221.        LOSS  OF  PROFITS, USE, DATA, OR OTHER ECONOMIC ADVANTAGE), HOW-
  222.        EVER IT ARISES AND ON ANY THEORY OF  LIABILITY,  WHETHER  IN  AN
  223.        ACTION  FOR CONTRACT, STRICT LIABILITY OR TORT (INCLUDING NEGLI-
  224.        GENCE) OR OTHERWISE, WHETHER OR NOT SUCH PARTY HAS BEEN  ADVISED
  225.        OF  THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING THE FAIL-
  226.        URE OF ESSENTIAL PURPOSE OF ANY REMEDY.

  228.        8.  MISCELLANEOUS
  229.  
  230.        8.1.  Merger
  231.  
  232.        This License represents the complete agreement between  You  and
  233.        BitMover  regarding  the  BitKeeper  Software  covered  by  this
  234.        License.  BitMover reserves all rights not specifically  granted
  235.        herein.
  236.  
  237.        8.2.  Assignment
  238.  
  239.        BitMover may assign this License, and its rights and obligations
  240.        hereunder, at its sole discretion.
  241.  
  242.        8.3.  Severability
  243.  
  244.        If any provision of this License is held  to  be  unenforceable,
  245.        such provision shall be reformed only to the extent necessary to
  246.        make it enforceable.  If any provision of this License  is  held
  247.        to  be unenforceable, the enforceability of the remaining provi-
  248.        sions of this License will not be impaired thereby.
  249.  
  250.        8.4.  Governing Law/Jurisdiction
  251.  
  252.        This License shall be governed by the laws of  the  US  and  the
  253.        State of California, as applied to contracts entered into and to
  254.        be performed in California between  California  residents.    By
  255.        using this product, You submit to the jurisdiction of the courts
  256.        in the Northern District of California.
