  7.              Congressman Declares War on US Software Companies
  8.               Children's and Educational Programs Endangered

  10.      US Representative Tom Lantos (D-Calif) has declared war on small
  11. American software businesses. In a public hearing held in San Francisco on
  12. May 21, Lantos reaffirmed his support for the establishment of an expensive
  13. private bureaucracy for the purpose of applying ratings to computer games,
  14. even if it means the destruction of hundreds of small companies. This plan
  15. would be administered by the Interactive Digital Software Association
  16. (IDSA), an organization created by a few giant video game manufacturers.
  17.      The IDSA plan would require the publishers of computer games to
  18. produce and submit videotapes, pay processing fees of $500 or more, and
  19. await review by a secret committee before they could release products in
  20. the marketplace. In contrast to this plan, four major trade associations,
  21. representing over 3000 businesses, are in the process of developing a
  22. standardized ratings system that could be quickly and accurately applied to
  23. software as part of the development process, and which would impose no fees
  24. on the publishers.
  25.      Although the IDSA plan has been heavily criticized by both independent
  26. publishers and the trade associations, and has not yet started operation,
  27. Lantos, along with Senators Joseph Lieberman (D-Conn) and Herbert Kohl
  28. (D-Wisc), has already sent letters on Congressional letterhead to major
  29. retailers, urging them to purchase software only from businesses which
  30. submit to the IDSA plan.
  31.      According to software industry spokesperson Karen Crowther, the costs
  32. and delays of the IDSA plan would be devastating to many small and
  33. entrepreneurial software businesses which produce children's and
  34. educational software. Lantos' response was that "protecting our children"
  35. is more important than the survival of these companies. Ironically,
  36. Nintendo and Sega, billion-dollar companies and major proponents of the
  37. IDSA plan, publish "Mortal Kombat", the game most often cited by Lantos in
  38. his campaign against "filthy and disgusting" video games.
  39.      Daniel Sejzer, president of Villa Crespo Software, a games publisher
  40. based in Chicago, labeled the IDSA plan "ridiculous. Under no circumstances
  41. should publishers agree to reveal their trade secrets and new concepts to
  42. outsiders." Sejzer added that he would favor self-applied ratings following
  43. industry guidelines.
  44.      Rosemary West, president of the Educational Software Cooperative
  45. (ESC), representing over 50 companies, said "If implemented, the IDSA plan
  46. would actually prevent distribution of many wholesome, educational games,
  47. because the smaller developers simply cannot afford these unnecessary
  48. costs."
  49.      Crowther added that the IDSA plan would assist foreign-owned Nintendo
  50. and Sega in "crushing their smaller, U.S. competition" and asked, "Why is
  51. Lantos supporting an anti-competitive ratings system instead of one
  52. developed by our own games publishers?" She pointed out that callers
  53. requesting information from Lantos' office are given the phone number for
  54. IDSA's Washington lobbyist.
