  2.                      "HoroScopeDoor" SUBSCRIBER AGREEMENT

  6. This document outines an agreement between SpeakEasy BBS Services, 
  7. (HoroScopeDoor), and the owner/operator of the online information 
  8. service/electronic bulletin board system described below, hereafter 
  9. referred to as the subscriber, regarding distribution, delivery, 
  10. receipt and online display of "HoroScopeDoor" (Horo). 
  11.  
  12. 1. NATURE OF AGREEMENT. In exchange for the subscription fee described
  13. in this agreement, HORO agrees to make available to the subscriber, on a
  14. BEST EFFORT basis, the full text of the current isssue of HORO. Subscriber
  15. may receive these files and is licensed to display them on the single
  16. electronic bulletin board system described below for the duration of this
  17. agreement.

  19. 2. TERM. This agreement begins on the date of receipt of subscription fee
  20. and continues for a period of THREE MONTHS thereafter (12 issues). Subscriber
  21. may renew this subscription in a minimum of THREE MONTH intervals on 
  22. approval of SPEAKEASY BBS SERVICES.

  24.   NOTE!  For a limited time a TRIAL subscription of ONE MONTH, (four issues)
  25.          is available. See Number 6 below.

  27. 3. TRANSPORTATION. Subscriber assumes all responsibility for all
  28. communications/transportation fees necessary to download HORO.DAT files from
  29. the distribution point in Sacramento, California area code 916.
  30.  
  31. 4. RESALE OR REDISTRIBUTION. Subscriber agrees to not resell or redistribute
  32. HORO dat files without written authorization from SPEAKEASY BBS SERVICES. 
  33. System operators may provide ONLINE access to HORO to their callers
  34. at whatever fee or lack of fee the subscriber deems appropriate.

  36. 5. FILE INTEGRITY/COPYRIGHT NOTICE. Subscriber agrees not to alter any
  37. received files, remove any copyright notices, add to, delete from, or other-
  38. wise modify or append to HORO files. All files will be displayed unaltered
  39. and unmodified and in their entirety.

  41. 6. SUBSCRIPTION FEE. The quarterly subscription fee is $20.00 (12 issues)
  42.                      The MONTHLY subscription fee is $10.00 (4 issues)
  43.  
  44. 7. PAYMENT.  Payment for HORO will be made in advance. 
  45.

  53. 8. SUBSCRIBING SYSTEM ACCESS. Subscriber agrees to provide HORO with full
  54. USER access to all areas of BBS owned or operated by subscriber at no charge
  55. or access fees for the duration of the agreement.
  56.  
  57. 9. FAILURE TO DELIVER. Subscriber will hold HORO, SPEAKEASY BBS, DRsoft
  58. AND ROBERT ARGUELLO harmless for any and all damages real, incidental, or
  59. consequential caused by nonavailability or nondelivery of HORO for any 
  60. reason whatsoever. It is understood that delivery/availability of HORO is
  61. made on a best effort basis.
  62.  
  63. 10. REVOCATION FOR CAUSE. Violation of any of the terms of this agreement
  64. or any misrepresentations of BBS status or readership by the subscriber
  65. will result in the immediate cancellation of license and delivery of HORO
  66. without refund or recourse.

  68. 11. NORMAL CANCELLATION. This agreement will terminate normally at the end
  69. of the subscription period unless renewed by subscriber and
  70. with approval of HORO.
