  1. W i n N E T   M a i l (TM)
  2.  
  3. Terms and Conditions.
  4.  
  5. 1.  The WinNET Mail (TM) software is distributed freely for
  6.     the purpose of connecting with the WinNET service.
  7.     There is no charge for the software as long as it is
  8.     used for this purpose. 
  9.  
  10. 2.  The WinNET service is billed on a connect time basis at
  11.     the rate of
  12.     
  13.                 $8.00 per hour
  14.                 
  15.     There is a monthly minimum charge of $9.95 while you 
  16.     have an account with us.  This means that if you use less 
  17.     than $9.95 worth of connect time (billed at $8.00 per 
  18.     hour), you will be billed the minimum of $9.95.
  19.      
  20.     There is a per account minimum charge of $9.95.  
  21.     Accounts created and then ended shortly thereafter will 
  22.     be billed at minimum $9.95.
  23.  
  24.     The minimum monthly charge is prorated to the actual
  25.     number of days of service in the first month of service
  26.     and in the last month of service. 
  27.     
  28.     There is no charge for new account set up other than
  29.     a minimum life-time charge of $9.95 per account. 
  30.     Accounts that are created and then disconnected before
  31.     billing $9.95 in connect time or monthly minimum
  32.     charges will be billed a total of $9.95.
  33.  
  34.     Connect time is recorded in increments of one minute. 
  35.     Fractions of minutes are billed as full minutes.  All
  36.     amounts are denominated in U.S. dollars.

  38. 3.  1-800 number service.  Computer Witchcraft offers a
  39.     1-800 number service to use to connect with our service.
  40.     The following surcharges apply when using the 1-800
  41.     number service:
  42.     
  43.         M-F, 8am-5pm      18 cents/minute
  44.         All other Times   12 cents/minute
  45.         
  46.     When using the 1-800 number service, Computer Witchcraft
  47.     will calculate your usage and place the appropriate
  48.     charges on your monthly statement. 
  49.  
  50.     Connect time is recorded in increments of one minute. 
  51.     Fractions of minutes are billed as full minutes.  All
  52.     amounts are denominated in U.S. dollars.
  53.  
  54.     Please note that communication's surcharges do not 
  55.     apply towards the monthly minimum charge of $9.95.
  56.  
  57. 3.  Payment.  As part of your account registration we
  58.     request a credit card number for payment.  You will be
  59.     charged $9.95 when you first establish your account as
  60.     your account's life-time minimum charge.  This $9.95 is
  61.     fully credited toward connect time charges and your
  62.     monthly minimums if you continue your account.
  63.     
  64.     You will be sent a statement of account usage via
  65.     WinNET mail after the end of the month.  Your credit 
  66.     card will be charged for the amount on the statement.
  67.     
  68.     Other payment arrangements are possible, please contact
  69.     us. 
  70.  
  71. 4.  Ending Service.  If you choose to terminate your account
  72.     on WinNET, all you need to do is contact us by WinNET
  73.     Mail, letter, or telephone.  We will end your service on
  74.     the date that you request and prorate your minimum
  75.     charge for that month accordingly.

  77. 5.  Computer Witchcraft exercises no control whatever over
  78.     the content of the information passing through the
  79.     WinNET system.  Computer Witchcraft is not responsible
  80.     for the accuracy, quality, or content of the information
  81.     obtained through its service.  Computer Witchcraft makes
  82.     no warranty, whether expressed or implied, for the
  83.     service it offers.  Computer Witchcraft disclaims any
  84.     warranty of merchantability of fitness for a particular
  85.     purpose.

  87. 6.  Computer Witchcraft makes no warranty whether expressed
  88.     or implied for the WinNET Mail software.  No warranty of
  89.     merchantability or fitness for a particular purpose is
  90.     provided for the WinNET Mail software. 
  91.  
  92. 7.  WinNET may only be used for lawful purposes.
  93.     Transmission of any material in violation of United
  94.     States law, laws of the nation in which WinNET is used,
  95.     or state law or regulation is prohibited.  This 
  96.     includes, but is not limited to: copyrighted material,
  97.     material legally judged to be threatening or obscene, or
  98.     material protected by trade secret.  You agree to
  99.     indemnify and hold harmless Computer Witchcraft from any
  100.     claims resulting form your use of the WinNET service or
  101.     WinNET Mail software which damages you or another party.

  103. 8.  The WinNET Mail (TM) software may be distributed by you
  104.     to others as long as you agree to all conditions listed
  105.     in the READ-1ST.TXT and VENDOR.TXT files.
