  8. If your incorporated business has 50 or more employees and
  9. is considered to be in an industry that uses, generates, or
  10. stores hazardous materials in California, it must file an
  11. environmental fee return and pay an annual environmental
  12. fee based on its number of employees, as follows:

  24. While you might not think your business has anything to do
  25. with hazardous materials, the state aggressively interprets
  26. this law to apply to ALL corporations with 50 or more em-
  27. ployees.  Because of the state's extreme interpretation of
  28. the law, you may want to pay the fee and file for a refund
  29. at some point in the future, if you think your corporation
  30. does not "use, generate, or store" hazardous materials.  It
  31. seems likely that the state's position will be challenged
  32. in the courts, which might permit you a refund if you have
  33. filed for it before the statute of limitations has expired.
