Conservation Easements
Have you had any experience with conservation easements? I seek tales of
conservation easements good, bad, indifferent, and indeterminate. I need
information from grantees, grantors, afflictees, and afflictors.
I own and live on a mile of a "Wild and Scenic River", and have heard rumors of
a timber easement. Unfortunately, I, as the landowner, am in the position of
being more valuable ignorant then enlightened. I'm especially interested in
The Nature Conservancy "INDENTURE" and in dealings with governments.
The way that I read the legalese from The Nature Conservancy, the Grantee may
prohibit any land use and any activity thereon, which, in the opinion of the
Grantee, is or may become inconsistent with the grant. In the opinion of this
grantor, this is granting <everything> in the property ownership (except,
perhaps, for paying the taxes).
Governments, of course, always have the right to change the rules any time that
they opine to.
