Day 247 - 10 May 96 - Page 05

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: Or rather I will call her Ms. Bensilum.

MR. RAMPTON: They are a separate document from the typewritten
       ones.

MR. JUSTICE BELL: Yes. Thank you.

Is there anything you want to say about the further
disclosure? I am not inviting you to; I am just giving you
an opportunity before Mr. Preston comes back into the
       witness box?

MR. MORRIS: I am just checking. I am not aware of this legal
hiatus in our claim that we need to plead individuals
motivated by malice regarding the counterclaim. But
certainly if that is what is needed, then we would have to
       do that.

MR. JUSTICE BELL: What I suggest is that you think about that
and then when we have a gap after today, if you want any
further discussion of that, raise it. My main concern
obviously at the moment is to carry on with Mr. Preston's
evidence, and I do not think anything Mr. Rampton has said
       affects that.

  MR. MORRIS: Right.

MS. STEEL: Can we say as well, for the record, that we reject
what Mr. Rampton was saying about misusing this. I am not
quite sure how you would misuse names of people present at
meetings anyway, but I would like it on the record that we
do not accept any of what he is saying.

MR. JUSTICE BELL: No further ruling is required from me on this,
so I propose to say no more about it.

MR. MORRIS: Can I ask, while we are having a look, dealing with
a couple of bits and pieces, that we get a copy of the
video from America that we had the transcript for?

MR. RAMPTON: Yes. It has been prepared. We want to look at it
ourselves. We have not had a chance. Mrs. Brinley-Codd
got it this morning. We will look at it after court today
and then it will be transmitted by some convenient means.

There are only 3 copies being made. What we are proposing
is that your Lordship has one, there is one to be left in
court, and the Defendants will, on this occasion, we would
       suggest, share one.

MR. JUSTICE BELL: If they want they can borrow mine and then
I will ask either Ms. Steel or Mr. Morris to hand a copy
back to me if and when it is shown.

MR. RAMPTON: It is going to be very short.

MR. JUSTICE BELL: I am not going to look at it unless I am
