Day 155 - 14 Jul 95 - Page 03

MR. RAMPTON: My Lord, I only add I am hoping that Mr. Atkinson
will be able to find most of what is on that list somewhere
or other. The ECHR case is, no doubt, a decision of the
Strasbourg Court of Human Rights. That should be
available. There are, however, listed a number of,
I think, applications. I am not at all certain if they are
reported anywhere because unless they have actually been
decided by the European Court, they will remain as
applications to the Commission which has, as your Lordship
knows, a filtering function before it gets to the court,
and whether we will ever find those I do not know. In so
far as we are able to find what the Defendants have not, we
       will provide copies.

                      MR. TONY GIARDINA, sworn
                      Examined by MR. RAMPTON QC.

  Q. Mr. Giardina, I have you down as Tony Giardina; are those
       your full names?
       A. That is correct.

  Q. Can you please keep your voice as loud as possible because
this court is difficult for hearing. I am the furthest
away. If you make sure that I hear, then everybody else
       will hear as well.
       A. OK.

  Q. Are you, Mr. Giardina, the General Manager of the
       McDonald's store in the Strand?
       A. That is correct.

  Q. How long have you been in that position?
       A. Since September 1st of last year.

  Q. September 1st, 1994. What position did you hold prior to
       that?
       A. I was an Area Manager for four restaurants in Central
       London.

  Q. Is that Area Manager the same thing as Area Supervisor?
       A. The same thing, yes.

  Q. Which were those four restaurants in Central London?
       A. At the time it was Haymarket, Tower Hill, Kensington
       and Oxford Street.

  Q. One of the Oxford Street restaurants?
       A. Yes.

  Q. When did you start your career at McDonald's?
       A. January 1982. I was a crew member at the Enfield
branch, I think it was about 85/86. I then worked through
all the hierarchy etc. etc., and became a Second Assistant,
I think it was in 85.

  Q. So you had started off as ordinary crew member in Enfield
       in January 1982?
       A. That is correct.

  Q. Did you go on to be Floor Manager?
