     3   MR. JUSTICE BELL:  I am sorry to hear about the accident to your
     4        son.  The question is what, if anything, do we do now?

     6   MR. MORRIS:  Right.  I apologise for not being able to attend
     7        last week.
     8
     9   MR. JUSTICE BELL:  No, I understood that.

    11   MR. MORRIS:  What I was going to ask for was an adjournment
    12        until my son was back on his feet again.  Yesterday I went
    13        to the fracture clinic and they have varied their
    14        prognosis, I suppose you could call it -- I am not sure if
    15        that is the word -- that he is no longer
    16        non-weight-bearing, his leg, he can put weight on it, and
    17        also he does not have to stay at home.  In the light of
    18        that, I phoned the school.

    20   MR. JUSTICE BELL:  That is as of now, is it?

    22   MR. MORRIS:  As of yesterday, yes.  He has to, well, I have to
    23        teach him how to use the frame, the walking frame.

    25   MR. JUSTICE BELL:  Yes.  But what sort of frame is it?  Is it
    26        like what I call a zimmer frame ---

    28   MR. MORRIS:  I think so.

    30   MR. JUSTICE BELL:  -- which has three sides of a square with
    31        four feet.

    33   MR. MORRIS:  Yes.  The school is prepared to accept him at
    34        school.  Oh, yes, I have also a wheel chair for him so that
    35        he can go out, and the school is prepared to take him after
    36        half term, so what I am, effectively, asking for today is
    37        an adjournment for the rest of this week from the schedule,
    38        and then to be able to restart again on, is it, the 5th?

    40   MR. JUSTICE BELL:  I think it is the 6th, it is the Tuesday.

    42   MR. MORRIS:  Tuesday, 6th.  Monday, is that a bank holiday?

    44   MR. JUSTICE BELL:  No, it is not.  The Bank Holiday is Monday,
    45        29th but the vacation between the two shorter than two
    46        usual terms extends into the Monday, so it is legal
    47        vacation.  I had not proposed to sit in any part of the
    48        vacation which lasts six days.  In fact, Mr. Rampton had
    49        anticipated that because the proposed schedule of witnesses
    50        starts again on Tuesday, 6th.

    52   MR. MORRIS:  Right.  So, that would be quite good because then 
    53        I would be able to see whether the Monday he was OK at the
    54        school or whether there was any problem about it, but
    55        I should not think there will be a problem.

    57        Going to the Court of Appeal case which was referred to in
    58        the White Book, on page 616, I do not know if you want to
    59        get it?
