  2. LICENSE AGREEMENT

  4. All information recorded on the disks / CD-ROM is denoted Software in the
  5. following.  The Software is the property of Virtek International Corporation,
  6. 3 Christina Center , Wilmington, DE, USA. You are not allowed to reverse
  7. engineer, decompile or disassemble the Software. The Software is
  8. protected by US and international copyright laws, and all other
  9. international or national laws that may apply.

  11. Virtek International Corporation hereby grants you a non-exclusive
  12. license to use the Software as follows: You may use the Software
  13. on any computer, provided that the Software, or any part of the
  14. Software cannot possibly be used on any other computer or by any
  15. other person at the same time. This means that if a team is
  16. working on a project, where each person is using a part of the
  17. Software, each person must have a licensed copy of the Software
  18. or be covered by the Virtek site-license agreement. You may make
  19. copies of the Software for the sole purpose of loading it into
  20. the computer on which you wish to use it, or for keeping a maximum
  21. of two back-up copies.. You are furthermore granted the royalty free
  22. right to use, sell and otherwise distribute programs developed by you
  23. using the 3D-Ware Library provided as part of the Software. You are also 
  24. allowed to use, sell and distribute the compiled 3D shape files
  25. (*.3D) supplied with the Software. All use and distribution are 
  26. subject to the following terms and conditions:

  28. 1. Any parts of the Software you are allowed to distribute, as specified
  29. above, remain the property of Virtek. You are not allowed to transfer the
  30. above rights to incorporate any part the 3D-Ware Library and compiled
  31. shape files into a program to any other person or organisation. You are,
  32. however, allowed to let other persons or organisations resell a program you
  33. have developed in compliance with the terms and conditions of this agreement.

  35. 2. You are not allowed to supply any part of the 3D-Ware Library or
  36. compiled shape files in any form intended for use by another program.
  37.  
  38. 3. You are not allowed to rent or lease out any part of the Software.
  39.  
  40. 4. You must keep all source code, header files, definition files and
  41. interface files relating to the 3D-Ware Library in the strictest of
  42. confidence.

  44. 5. Your software documentation must contain the following notice
  45. clearly displayed: "Parts of this program,  (C) Virtek International
  46. Corporation."
  47.  
  48. 6. Your program must display the line: "3D graphics by Virtek
  49. International Corp." for a period of not less than 2 seconds.
  50.  
  51. 7. If you sell or distribute more than 10,000 copies of a product
  52. containing any part of the 3D-Ware Library you must notify Virtek
  53. in writing immediately. Please note there will be no royalty to pay
  54. either before or after you reach the 10,000 copy limit. Virtek
  55. simply requires you to register your use of the software.

  57. This software product is owned by Virtek International Corporation, a
  58. Delaware Corporation. It is protected by US and international copyright
  59. laws, and all other international or national laws that may apply.

  61.  LIMITED WARRANTY
  62.  
  63. Virtek warrants that the 3D-Ware files are accurate copies of the
  64. software and will replace any mechanically defective copies
  65. free of charge for a period of 60 days after purchase. Virtek warrants
  66. that the software will perform substantially as described in the enclosed
  67. documentation for a period of 90 days. Virtek's entire liability and
  68. your only remedy shall be, either a refund of the price you paid,
  69. or that Virtek repairs any defects within 60 days. Virtek alone decides
  70. which of the above remedies shall be used.

  72. Virtek hereby disclaims all other warranties whether expressed or
  73. implied, including, without limitation, any implied warranties of
  74. merchantability and fitness for any particular purpose. Virtek shall
  75. have no liability for consequential, incidental, exemplary, special
  76. or any other kind of damages including lost profits. Virtek reserves
  77. the right to change the software and documentation at any time, without
  78. prior notice.
