  3. SIMITAR SOFTWARE MULTIMEDIACLIPS LICENSE

  5. Copyright 1993-1994 Simitar Software. All Rights Reserved.

  7. United States copyright law and international copyright treaties
  8. protect these MultimediaClips images. Simitar Software depended on the
  9. availability of this protection when it decided to spend the time and
  10. money required to produce these MultimediaClips images. Nevertheless, Simitar
  11. Software realizes that you have licensed this copy of the images so
  12. that you could copy the images in their present or a modified form and
  13. incorporate them into another work.
  14.  
  15. Simitar Software therefore gives you permission to copy and modify
  16. MultimediaClips images for your own use. MultimediaClips images may not be
  17. distributed as part of any software product or as part of an
  18. electronic document or collection of documents without written
  19. permission from Simitar Software. Simitar Software, however, gives you
  20. permission to incorporate and distribute duplicate or modified
  21. MultimediaClips images as an incidental part of any product or collection of
  22. products which are distributed commercially (i.e., distributed for
  23. profit, such as a newsletter); provided the use or distribution of any
  24. MultimediaClips images does not constitute a substantial portion of the value
  25. of the goods distributed commercially. For example, you may not,
  26. without written permission from Simitar Software, use a MultimediaClips
  27. images as an art image on a T shirt or poster manufactured for resale.
  28. You may not make any copies of any portion of the MultimediaClips images
  29. library for distribution or resale. Except as specifically stated
  30. above, you may not copy, modify, or distribute MultimediaClips images.

  32. Simitar Software grants you this license for a single CPU (central
  33. processing unit) only. This software may not be loaded onto a Local
  34. Area Network unless a license has been purchased for each CPU on the
  35. Network. Please call or write Simitar Software for more details
  36. regarding Network Licenses and Site Licenses.
  37.  
  38. Please write Simitar Software if you wish to obtain a license to
  39. distribute duplicate or modified MultimediaClips images other than expressly
  40. permitted under this license, or if you have any questions concerning
  41. your rights.
  42.  
  43. LIMITED WARRANTY
  44.  
  45. Simitar Software warrants to you, the original Licensee, that the
  46. MultimediaClips images are substantial in conformance with the visual index
  47. manual for a period of 90 days from the date of purchase. If a disk is
  48. defective, Simitar Software will replace the disk at no charge to you,
  49. if you return the disk to Simitar Software at the address below with
  50. proof of purchase within 90 days after you purchased it. Your sole and
  51. exclusive remedy, and Simitar Software's sole and exclusive liability,
  52. will be either replacement of the disk or a refund of the purchase
  53. price in accordance with this limited warranty.

  55. THE ABOVE WARRANTY IS THE ONLY WARRANTY OR REPRESENTATION OF ANY KIND
  56. WITH RESPECT TO MULTIMEDIACLIPS IMAGES MADE BY SIMITAR SOFTWARE OR ANYONE
  57. ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY, OR LICENSING OF
  58. MULTIMEDIACLIPS IMAGES. FURTHERMORE, ANY IMPLIED WARRANTIES WITH RESPECT TO
  59. MULTIMEDIACLIPS IMAGES DISKS/CD-ROMS, INCLUDING IMPLIED WARRANTIES OF
  60. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT
  61. OF THIRD PARTY RIGHTS, ARE SPECIFICALLY DISCLAIMED.

  63. NEITHER SIMITAR SOFTWARE NOR ANYONE ELSE INVOLVED IN THE CREATION,
  64. PRODUCTION, DELIVERY, OR LICENSING OF MULTIMEDIACLIPS IMAGES MAKES ANY
  65. WARRANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, WITH
  66. RESPECT TO MULTIMEDIACLIPS IMAGES OR THEIR QUALITY, RELIABILITY, OR
  67. PERFORMANCE, OR THEIR MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR
  68. PURPOSES. MULTIMEDIACLIPS IMAGES ARE LICENSED "AS IS. " YOU ASSUME THE ENTIRE
  69. RISK AS TO THE QUALITY, RELIABILITY, AND PERFORMANCE OF THE IMAGES. IF
  70. THE MULTIMEDIACLIPS IMAGES PROVE DEFECTIVE, YOU, AND NOT SIMITAR SOFTWARE OR
  71. ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY, OR
  72. LICENSING OF MULTIMEDIACLIPS IMAGES, MUST ASSUME THE ENTIRE COST OF ALL
  73. NECESSARY CORRECTIONS.

  75. DISCLAIMER OF DAMAGES
  76.  
  77. IN NO EVENT WILL SIMITAR SOFTWARE OR ANYONE ELSE INVOLVED IN THE
  78. CREATION, PRODUCTION, DELIVERY, OR LICENSING OF MULTIMEDIACLIPS IMAGES BE
  79. LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, DIRECT, OR
  80. INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE USE OF MULTIMEDIACLIPS IMAGES
  81. OR ANY DEFECT IN THE MULTIMEDIACLIPS IMAGES, EVEN IF SIMITAR SOFTWARE OR
  82. ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY, OR
  83. LICENSING OF MULTIMEDIACLIPS IMAGES HAS BEEN ADVISED OF THE POSSIBILITY OF
  84. SUCH DAMAGES.

  86. This notice will be construed, interpreted, and governed by the laws
  87. of the state of Minnesota as applied to transactions taking place
  88. entirely within Minnesota between Minnesota residents. Should you have
