Realworld Imagery™ License Agreement

TERMS OF USE

READ THIS LICENSE AGREEMENT BEFORE OPENING THIS PACKAGE AND INSTALLING THIS DISK. IT DEFINES YOUR RIGHTS AND OBLICATIONS. BY BREAKING THE SEAL, INSTALLING AND USING THIS DISK, YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT.

If you do not agree to these terms you may return this entire package unused and unopened, within 15 days, to the person from whom you acquired it for a full refund.

GRANT OF LICENSE. This license is not a sale. InterDimensional Publishing grants you the non-exclusive, non-transferable license to use the images contained on each Realworld Imagery CD subject to the conditions contained herein. You may not rent, loan, disseminate, publish electronically or by printed media, sell, sublicense, assign, transfer, or grant any rights to this Agreement or the images contained hereon, or grant rights to any compilation, derivative or collective work containing such images to any other person or organization without prior written consent of InterDimensional Publishing. You may not use this product on more than one computer or workstation at a time, or on a network or a multi-user system.

This license agreement DOES PERMIT the following uses of these image(s):

You may use these images in your personal, professional, internal, editorial, and client projects where the use of the image is to show a real-looking person in the context of a design simulation or visualization. For example, if you are designing a building, you may use these images for purposes of illustrating scale and human use of the building in your rendering.

This license agreement DOES NOT PERMIT the following uses of the image(s):

You may not use or copy the image(s), or any part thereof and/or the written materials accompanying the product except as permitted by this agreement.

You may not use or permit the use of the image(s), or any part thereof, as a trademark or service mark, or claim any proprietary rights of any sort in the image(s) or any part thereof.

You may not use, or allow anyone else to use any of these images to create pornographic, libelous, obscene or defamatory images. You also may not use these images in a context where printed material states, implies or could be thought to imply something about the image.

You may not post or permit the posting of any image(s) from this disk on any electronic bulletin board or website, or put the images on-line in a downloadable format.

You may not sell or distribute any image or images, as digital files, in any size or format, either alone or as part of a digital file library or other product.

You may not use or permit the use of the images, or any part thereof, including derivative works, in any product for resale or in advertising.

Using an image or images from the collection in a way not covered or specifically prohibited by this agreement without prior written consent from InterDimensional Publishing, is a violation of United States copyright law and International Treaty provisions. This license is in force until it is terminated. If you do not comply with the terms and conditions above, this license automatically terminates. At termination, the product must be returned to InterDimensional Publishing, or its reseller immediately.

COPYRIGHT. All digital image files contained on this CD are owned by InterDimensional Publishing, and are protected by the United States copyright laws, International Treaty provisions and other applicable laws. No title to or intellectual property rights to the images, or the CD are transferred to you. InterDimensional Publishing retains all rights not expressly granted by this license agreement. Realworld Imagery is a trademark of InterDimensional Publishing.

LIMITED WARRANTY. InterDimensional Publishing warrants this disk to be free from defects in material and workmanship for 90 days from delivery. Your sole and exclusive remedy for a breach of this warranty is the replacement of the CD at the option of InterDimensional Publishing. InterDimensional Publishing makes no other warranty either expressed or implied, of merchantability, fitness for any particular use, or compatibility with any computer or other kind of equipment. Neither InterDimensional Publishing, nor any of its trustees, agents, employees, distributors, resellers, representatives or associates shall be liable for any damages, whether direct, indirect, consequential or incidental, arising out of the use of, or inability to use, this disk or any image or images on this disk. All sales final.

US GOVERNMENT RESTRICTED RIGHTS. The Product is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the government is subject to restrictions set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, and paragraph (d) of the Commercial Computer Software-Restricted Rights clause at FAR 52.227-19. GOVERNING LAW AND GENERAL PROVISIONS. This License is the entire agreement and supersedes any other agreement or discussions, oral or written and may not be changed except by a written signed agreement. This License shall be governed and construed in accordance with the laws of the State of New Mexico, excluding the application of its conflicts of law rules. You agree that the digital images contained on this CD will not be shipped, transferred or exported into any country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions or regulations. This Agreement shall automatically terminate upon failure by you to comply with its terms.
