Freeway Software makes no representation or warranties of any kind whatsoever with respect to the use of this software and specifically disclaims any implied warranties of merchantability or fitness for any particular purpose. In no event shall Freeway or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use the software, even if Freeway has been advised of the possibility of such damages. This licence authorises the customer to use the licensed programs in any machine readable form on any single computer system. The customer may not copy in whole or in part any licensed documentation which is provided by Freeway Software in printed form under this agreement. Any of the licensed programs which are provided by Freeway Software in machine readable form may be copied for backup purposes provided however that there are no more than five copies in existence under any licence at any one time without prior written consent from Freeway Software. The customer shall not modify or adapt the licensed programs or documentation, including but not limited to, translating, decompiling, disassembling, or creating derivative works without prior written permission from Freeway Software. This agreement and any of the programs or materials to which it applies may not be assigned, sub-licensed or otherwise transferred by the customer without prior written consent from Freeway Software. No right to print or copy, in whole or in part, the licensed programs is granted except as expressly provided under this agreement. The customer acknowledges that any and all of the trade marks, trade names, copyrights, patents and other intellectual property rights used or embodied in or in connection with the licensed programs shall be and remain the sole property of Freeway Software and/or such other party as may be specified therein and/or thereon. The customer shall not during or at any time after the expiry or termination of this agreement in any way question or dispute the ownership by Freeway Software and/or the owner of any such rights. If any of the above provisions thereof are invalid under any applicable law or act of Parliament, they are to that extent only deemed to be omitted. The governing law of this agreement shall be that of England.
