iPad may boost magazine circulation
Magazine publishers may have a new way to boost flagging circulation: the iPad. The Audit Bureau of Circulations has changed its definition of a digital magazine to accommodate the new class of tablets such as the Apple device. The new rules allow publishers to count paid digital subscriptions as part of a magazine's overall circulation as long as all the same editorial and advertising material is included, according to the "Associated Press" (http://news.yahoo.com/s/ap/20100316/ap_on_hi_te/us_tec_magazine_circulat...). That means publishers can custom design their articles and photo spreads for the iPad. Without the rule change, they could only count digital editions that appear exactly the way they do in print, notes the "AP." The iPad is available for pre-order at the online Apple Store ("http://www.apple.com). It's due to ship on Saturday, April 3. At least the Wi-Fi only version will; the Wi-Fi + 3G model will hit US store sleeves in late April. In addition, all models of iPad...

Nexus One selling at a slower pace than the first iPhone
Google's Nexus One phone is selling at a a slower pace than the first iPhone, reaching about 135,000 units in the time it took Apple to sell one million, according to Flurry Analytics (http://www.flurry.com/) -- a cross-platform mobile application analytics provider. The original iPhone hit the one million mark after 74 days on sale in 2007. The Nexus One will have sold about one-eighth as many units on its 74th day on March 19, estimates Flurry. Google introduced the Nexus One in January, selling it through its web site. U.S. consumers aren’t accustomed to buying phones that way, which may have hurt sales of the Nexus One, Peter Farago, vice president of marketing at Flurry told "Bloomberg" (http://www.bloomberg.com/apps/news?pid=20601204&sid=ajrMKRizVpxI). “As successful and talented as Google is online with paid search and other kinds of related businesses, the hardware business is very different,” he said. iPad pre-orders top 150,000, most accessories delayed
Pre-order numbers for the iPad topped 150,000 pre-orders -- and that doesn't count people’s store reservations, according to a BGR report (http://www.boygeniusreport.com/2010/03/15/apple-ipad-pre-order-numbers-t...). "We have also been told Apple’s flagship 5th Avenue store in New York now holds around 1600 reservations for iPads, with 800 in the first day, and about 400 a day since," the article adds. "Lastly, store reservations seem to be split around 50% for the 32GB unit, 30% for the 64GB unit and about 20% for the 16GB, which is what Apple was expecting.” The iPads themselves are still expected to ship on time. However, if you've ordered iPad accessories, they're being delayed, according to dates at the Apple online store, though Apple doesn't say why. Apple's iPad case is delayed until mid-April. The iPad keyboard dock and power adapter are delayed until May. And there's no ETA for the Camera Connection Kit. However, the regular iPad Dock and the Dock Connector to VGA adapter...

Nearly 40% of Blackberry users continue to prefer Apple's iPhone as their next smartphone purchase, but a third of them would also switch to the Android operating system, according to the second smartphone brand loyalty survey conducted semi-annually via Crowd Science's (http://www.crowdscience.com) research platform for online audience measurement. The Crowd Scientists also found Android users rivaling iPhone users in loyalty, with about 90% of each user group planning to stick with their current brand when buying their next phone. Three-day estimate of iPad sales: 152,000 units
After the initial burst of excitement on Friday that saw iPad pre-orders coming in at the rate of 25,000 per hour, there was a dramatic fall-off over the weekend. Friday was when the Apple device was available for pre-order. According to Daniel Tello, the Venezuelan blogger-analyst who has been tracking order numbers submitted by volunteers at Investor Village's AAPL Sanity board, orders on Saturday and Sunday slowed to an estimated 1,000 per hour -- as reported by "Fortune" (http://brainstormtech.blogs.fortune.cnn.com/2010/03/15/apple-ipad-orders...). Telloattributes roughly half of the estimated 120,000 first-day sales to "pure overexcited fanboism." The real demand for the iPad in the weeks before its April 3 release, is probably closer to 30,000 per weekday and half that on weekends, he told "Fortune." "With three weeks and two weekends left before they ship, I wouldn't expect much more than half a million in pre-orders and reservations," he says. "My best guess, although very...

Apple-Nokia legal slugfest to recommence in 2012
The next round of legal smackdown between Apple and Nokia won't take place for a while. And look for a long, drawn-out battle. The two will seek a U.S. court hearing in a key patent battle in mid-2012, a court filing shows -- as reported by "Reuters" (http://www.reuters.com/article/idCNLDE62A2JN20100312?rpc=44). Last week federal judge in Delaware signed an order staying litigation in a lawsuit in which Nokia claims that Apple is infringing on seven Nokia patents in products ranging from the iPhone to computers. The order also covered counterclaims in which Apple alleges that Nokia has infringed on nine Apple patents that are the subject of an ITC complaint by Apple. Last month it was announced that Apple's patent-infringement complaint seeking to block Nokia Oyj’s phone imports into the U.S. will be investigated by a U.S. trade agency. The U.S. International Trade Commission in Washington will consider the complaint filed last month and decide whether to ban the imports. In...

Apple no longer has monopoly in using 'i' when...
Aye yi yi! No, make that "i, i, i." Apple has been told that it no longer has a monopoly on the letter "i" when trademarking its products. As reported by the "Sydney Morning Herald" (http://www.smh.com.au/digital-life/mp3s/apples-future-wont-be-brought-to...), IP Australia -- the government body that oversees trademark applications-- has knocked back Apple's bid to stop a small company from trademarking the name DOPi for use on its laptop bags and cases for Apple products. Apple argued that the DOPi name -- which is, in case you hadn't noticed -- iPod spelt backwards -- was too similar to its own product. IP Australia says that (http://www.austlii.edu.au/au/cases/cth/ATMO/2010/7.html) Apple seems to have overlooked the fact that there were already a large number of products that have the "i" prefix. While the case doesn't affect Apple's current trademarks, companies wanting to use the "i" prefix will have a better chance of getting away with it, lawyers told the "Sydney Morning...

He said Microsoft's Windows Phone 7 Series won't kill the iPhone, which exists in a class by itself, but it will be a potential "Android killer." Windows Phone 7 Series, Wolf said, is evidence that Microsoft "finally gets it."

Judge says to keep Pink Floyd albums intact
The rock band Pink Floyd have won a High Court battle to stop their record label, EMI, from selling album tracks as singles at places such as the iTunes Store. The legendary band, signed to EMI since 1967, said their contract meant their albums could not be split up without their permission. The BBC http://news.bbc.co.uk/2/hi/entertainment/8561963.stm) reports that a judge agreed, saying the contract contained a clause to "preserve the artistic integrity of the albums". EMI has been ordered to pay £40,000 (approximately $60,000) in costs, with a further fine to be decided. The group, whose latest contract was signed before download stores like iTunes appeared, also disputed the way royalties for digital sales were calculated.

Apple excels in 'Consumer Reports' rankings
"Consumer Reports" has published results of its latest survey (http://blogs.consumerreports.org/electronics/2010/03/best-and-worst-tech...) on the best and worst companies for computer tech support. And Apple, as you might expect, excelled. Scores are based on an annual survey from the Consumer Reports National Research Center this past January of over 7,000 desktop- and laptop-owning subscribers to "Consumer Reports." Respondents weighed in on the ability of manufacturer's tech support to solve their problems, the communication and knowledge of phone support staff, how long they were placed on hold, and the quality of the company's online support. "Consumer Reports" grouped together computer labels made by the same company (HP and Compaq were ranked together, for example). Of the six major manufacturers, one earned top marks across the board (guess who?), and left the others in its wake in terms of overall satisfaction. In striking contrast, another manufacturer received...

Apple threatened to sue Sun in 2003 over user interface design...
Sun Microsystems' former CEO, Jonathan Schwartz, says that Apple CEO Steve Jobs threatened to sue Sun for infringing on its intellectual property in 2003 for a user interface design. According to "CNET" (http://news.cnet.com/8301-30685_3-20000215-264.html?part=rss&subj=news&t...), Jobs delivered his threat to Sun personally, Schwartz said, calling his office to say the graphics in Sun's operating system 3D interface, Project Looking Glass, were "stepping all over Apple's IP," and that if Sun commercialized it, "I'll just sue you." Sun countered with its own patent portfolio, according to "CNET." With Apple, Schwartz raised the similarities between Apple's Keynote presentation software and Concurrence, software from Schwartz's start-up Lighthouse Design, which Sun acquired, the article says. And he pointed to Sun's operating system patents, relevant given its Unix history and the fact that Apple's Mac OS X uses Unix technology. "Steve was silent," Schwartz said.
