MobileSoft Labs End User License Agreement

This License Agreement governs your use of the enclosed Software product M.Play, which is a software midi player for the PalmOS device. By installing and/or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms and conditions, you may either a) promptly destroy all the components of this product or b) promptly return all the components of this product to MobileSoft Labs. LICENSE: This License Agreement allows you to use the enclosed Software. You may install the Software on a single or multiple PalmOS device(s) owned by you. You may also use the Software on a portable or home computer.

COPYRIGHT: The Software is owned by MobileSoft Labs ("M.Labs") or its suppliers and is protected by copyright laws and international treaty provisions.

REDISTRIBUTION: M.Labs grants you permission to copy and distribute this Software as long as you

1. copy and distribute all the components of this product including the complete Software and any accompanying printed materials, and including this license agreement,
2. do not make any changes to the Software or accompanying printed materials,
3. maintain all copyright notices with the Software, and
4. do not receive any money or other consideration for the Software.

OTHER RESTRICTIONS: This License must be retained by you. You may not reverse engineer, decompile, or disassemble the Software.

WARRANTY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, M.LABS DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND ACCOMPANYING WRITTEN MATERIALS.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL M.LABS OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT THE USE OR INABILITY TO USE THIS M.LABS PRODUCT, EVEN IF M.LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
