TPG
Internet Pty Ltd ACN 068 383 737 (hereinafter referred to as
“TPG”) and the Subscriber (being an entity subscribing to TPG
for the provision of Internet services) agree that by accessing
TPG Internet services, you accept, without limitation or qualification,
these terms & conditions: |

- TPG makes no warranties or representations as to the accuracy
of information in or linked to this web site and assumes
no liability or responsibility for any errors or omissions
in content.
- TPG shall not be liable for any damage to and/or viruses
that may infect your computer equipment or other property
on account of your access to, use of, or browsing of our
web site and/or your downloading
of any materials, data, text, images, video or audio from
the TPG Internet web site.
- The Subscriber acknowledges that the service is not fault
free and there may be interruptions and/or access difficulties
from time to time. TPG is not liable for any downtime or
for any problems that may arise due to the incompatibility
of modems or equipment.
- Any electronic mail or other material that you may transmit
or display will be treated as non-confidential and non-proprietary.
You have no right to use any Trademark displayed on the
TPG Internet web site without the permission of the party
that owns that Trademark.
- TPG may monitor or review information, mailings, chats,
and the like on the TPG Internet web site, but assumes no
responsibility or liability arising from the content nor
for any error, defamation, libel, slander, omission, falsehood,
obscenity, pornography, profanity, danger or inaccuracy
contained in any information. You are prohibited from posting
or transmitting any unlawful, threatening, libellous, offensive,
obscene, scandalous, inflammatory, pornographic, or other
materials that could constitute or encourage conduct that
would be considered a criminal offence, give rise to civil
liability, or otherwise violate any law.
- TPG reserves the right to suspend without notice any subscriber’s
account which, in its opinion, is involved in activities
which are detrimental to TPG’s Internet service or how the
wider community will perceive TPG. This includes, but is
not limited to, ‘Spamming’ e-mail or forwarding spammed
e-mail to other Internet user’s e-mail addresses, attempted
unauthorised access to other Internet servers and systems,
misrepresentation and abusive or offensive behaviour in
newsgroups and other online facilities, e-mail bombing and
the use of bulk e-mail programs to unsolicited recipients.
- TPG has the right to recover revenue from the Subscriber
for any costs incurred for damages and/or repairs and/or
maintenance and/or loss of business caused by, or resulting
from, any of the above activities (clause 5 & 6).
- TPG reserves the right to suspend without notice any subscriber’s
account involved in offensive and/or illegal activities
under State and/or Federal laws. In such a case the relevant
law enforcement agency (ies) will be notified, and where
possible offending material(s) passed on.
- The Subscriber is aware that TPG has a facility located
on the TPG Internet Web Site that shows the present status
of the Subscriber’s account. TPG’s pricing is based upon
regular utilisation of our Internet facilities and selected
packages purchased by the Subscriber have a minimum monthly
usage content. If this minimum monthly usage content is
not utilised in the time period allocated for such use,
then the unused hours for that month will be forfeited eg.
Basic Pack you must use a minimum of 12 hours per month,
Professional Package you must use a minimum of 50 hours
per month. The monthly time periods are calculated from
the date of the first access connection in calendar monthly
periods. The subscription expires at midnight on the last
day at the end of the last monthly time period or when the
total package hours have been used in full, whichever occurs
first.
- TPG packages may not be combined with any other TPG package
or offer. Any TPG package or offer may be changed or withdrawn
at any time, such change will take effect from the end of
your then current package.
- Wild, Value & Country packs are billed quarterly in advance.
Basic and Professional packs are billed annually in advance.
Trial and Modem + Value packs are billed in advance. The
monthly time period for all these packages is calculated
from the date of the first access connection.
- Administration fees only apply to the following TPG packages:
Trial pack once-off $39.95 inc GST, Modem + Value pack once-off
$43.95 inc GST which are non-refundable.
- Unlimited data
transfer applies to all TPG packages excluding the following:
Wild - 100Mb limit per month; Value - 300Mb limit per month;
Country - 350Mb limit per month; Modem + Value - 300Mb limit
per month. TPG will issue a warning via e-mail advising
the Subscriber they are approaching the limit. If the 350Mb,
300Mb or 100Mb limit per month is exceeded, over utilisation
will be charged at 18 cents inc GST per Mb and will be debited
monthly directly from the Subscriber’s credit card. Failure
to pay the additional charges may result in TPG terminating
the subscription, with no refund.
- Wild, Value, Country, Modem + Value and NiteRider pack:
TPG may disconnect an Internet session if an extended period
of idle time is detected or if a session exceeds 3 hours
(5 hours for Wild & Value Packs). Automated methods to avoid
disconnection are not permitted.
- Telephone connection charges are the Subscribers responsibility
and are in addition to TPG subscription charges. To ensure
the TPG Access number is a local call please contact your
telephone provider. TPG shall not be liable, or reimburse
Subscribers for any costs, technical support or phone charges
incurred while establishing connectivity with TPG.
- The Subscriber hereby authorises TPG to charge any excess
usage of their account at the current rate applicable to
TPG Subscribers at the time the excess hours were used,
and to debit any amounts due to TPG from any credit card
account previously given to TPG for billing purposes. The
Subscriber notes and agrees that any accounting and/or administration
and/or registration fees are not refundable and that cancellation
fees may apply. Dishonoured cheques incur a $16.50 inc GST
handling charge.
- Registration will not be processed without prior payment.
If an account is cancelled for any reason, neither the Administration
Fee nor any unused time will be refunded. If a Basic or
Professional pack is cancelled for any reason a cancellation
fee of $55 inc GST applies.
- For Credit Card Subscribers TPG will automatically renew
your subscription for the next period debiting the subscription
charges from the credit card provided unless written notice
of cancellation is received at least two weeks prior to
the expiration of the then current subscription. If such
written notice is not received, TPG will automatically debit
your credit card one-week prior to expiration for the next
period. TPG may not necessarily contact the Subscriber to
advise renewal.
- For other forms of payment, it is the Subscribers responsibility
to contact TPG to renew their subscription for the next
period. TPG may not necessarily contact the Subscriber to
advise renewal.
- The Subscriber is required to inform TPG if their credit
card is due to expire two weeks prior to the expiry date
and is required to provide TPG with details of a current
credit card.
- TPG reserves the right to check Subscriber’s details with
credit referencing bodies/associations.
- If the Subscriber, without prior written permission of
an authorised officer of TPG, transfers, assigns or divulges
any information which allows another person(s) or entity
(ies) to access the Internet by using the Subscriber’s allocated
username and/or password then the Subscriber will be liable
for any usage time incurred by the third party at the current
rate applicable, and that subscriber’s account may be terminated
immediately. This includes multiple concurrent logins of
the same username and/or password, excluding Easy pack subscribers.
- TPG does not under any circumstances permit the resale
to any other party of TPG Internet connections and/or bandwidth.
Any subscriber found doing this will be charged for all
of that subscriber’s usage and any other party’s usage to
whom they have sold or divulged material to enable access
to TPG’s Internet system at three times the current rate
applicable. TPG may terminate the Subscriber’s account without
notice and without refunding any subscriptions paid but
unused.
- TPG does not under any circumstances allow back channelling.
TPG reserves the right to charge subscribers for any incoming
or outgoing traffic if this is breached.
- TPG reserves the right to provide access to the Internet
via TPG Proxy Servers. During peak periods modems may not
always be available.
- Running servers or providing any public information services
from a computer connected via this service is prohibited.
- TPG may use the information you supply to contact you
regarding your account or other promotional matters.
- Terminal logins are not permitted.
- TPG Internet pricing is subject to change without notice.
ADDITIONAL TERMS & CONDITIONS FOR SPECIFIC PACKAGES
EASY PACK PACKAGE CONDITIONS
- Easy pack subscribers are billed monthly for the previous
months usage. The billing month begins on the date of first
usage. Usage is calculated in one-minute increments and
charging is rounded to the nearest cent. A minimum access
charge of $0.11 inc GST per session applies.
- Easy pack payment is by Credit Card only.
- Easy Pack is available in all TPG Locations.
- Easy pack subscribers may login for Internet access as
often as they wish whilst their subscription is current.
Use of the same Username to login from more than one computer
is permitted, however, all usage from multiple logins will
be charged and is the responsibility of the registered TPG
Subscriber.
- Easy pack customers renewing to an alternative package
must inform Customer Service on 1300 360 855.
WILD, VALUE, COUNTRY & TV PACKS PACKAGE CONDITIONS
- Wild & Value packs are available in Sydney, Albury, Armidale,
Bathurst, Coffs Harbour, Cowra, Dubbo, Gosford, Goulburn,
Grafton, Kiama/Wollongong, Lake Macquarie/Newcastle, Nowra,
Penrith, Port Macquarie, Tamworth, Wagga Wagga, Melbourne,
Ballarat, Bendigo, Geelong, Lilydale, Mornington, Morwell,
Sale, Shepparton, Warragul, Warrnambool, Brisbane, Atherton,
Bundaberg, Noosa Heads, Southport/Gold Coast, Toowoomba,
Canberra, Adelaide, Perth, Bunbury, Rockingham.
- Wild & Value pack subscribers will not be able to connect
via Points of Presence (PoPs) other than to those specified.
- Country packs are available in all TPG locations.
- Wild pack payment is by Credit Card only.
- Wild, Value & Country pack subscribers may login for Internet
access as often as they wish whilst their subscription is
current. Use of the same Username to login from more than
one computer at the same time is NOT permitted, and will
lead to immediate disconnection and termination of the user’s
subscription without further warning.
- Any unused time as at the date of cancellation will not
be reimbursed.
- Wild, Value & Country packs are not available for users
of permanent IP addresses. They do not provide for and are
not designed for continuous connection. Continuous connection
is available through a TPG Permanent Internet Connection.
E-MAIL ONLY PACK PACKAGE CONDITIONS
- E-mail only pack provides a mailbox for a period of 12
months, billed annually in advance, and is non-refundable.
No administration fees apply.
- E-mail only pack does not provide subscribers with any
Internet hours whatsoever.
Subscribers should note that these standard Terms &
Conditions and the additional Package Conditions may be
revised at any time by way of update on the TPG Internet
web site – www.tpg.com.au. Subscribers are bound by any
revisions as at the date they are displayed and should
regularly examine the current standard Terms & Conditions
and the additional Package Conditions displayed on the
TPG Internet web site.
