  20. charge to the user.  Feel free to share unlicensed copies
  21. with your friends, but please do not give it away altered
  22. or as part of another system.

  25. within 30 days of first use or their license is withdrawn.

  31. Registered User License Agreement

  34. This is a legal agreement between you (either an individual
  35. or an entity) and ToolPool. By using the SOFTWARE, you
  36. agree to be bound by the terms of this agreement.

  38. ===================  SOFTWARE LICENSE  ====================
  39. 1. GRANT OF LICENSE.  
  40. This License Agreement ("License") permits you to use one
  41. copy of the software product identified above, which may
  42. include user documentation provided in "on-line" or
  43. electronic form ("SOFTWARE"). The SOFTWARE is licensed as a
  44. single product.  Its component parts may not be separated
  45. for use on more than one computer or by more than one user
  46. at any time.  The SOFTWARE is "in use" on a computer when
  47. it is loaded into the temporary memory (i.e., RAM) or
  48. installed into the permanent memory (e.g., hard disk) of
  49. that computer.  If the SOFTWARE is permanently installed on
  50. the hard disk or other storage device of a computer and one
  51. person uses that computer more than 80% of the time, then
  52. that person may also use the SOFTWARE on a portable or home
  53. computer.

  55. 2. COPYRIGHT.  
  56. The SOFTWARE is owned by ToolPool and is protected by
  57. Austrian copyright laws and international treaty
  58. provisions.  Therefore you must treat the SOFTWARE like any
  59. other copyrighted material (e.g., a book or musical
  60. recording) except that you may either (a) make one copy of
  61. the SOFTWARE solely for backup or archival purposes, or (b)
  62. transfer the SOFTWARE to a single hard disk provided you
  63. keep the original solely for backup or archival purposes.
  64. You may not print copies of any user documentation provided
  65. in "on-line" or electronic form.  You must not redistribute
  66. the license key, which licenses your copy of the software.

  68. 3. OTHER RESTRICTIONS.  
  69. This License is your proof of license to exercise the
  70. rights granted herein and must be retained by you.  You may
  71. not rent or lease the SOFTWARE, but you may transfer your
  72. rights under this License on a permanent basis, provided
  73. you transfer this License and the SOFTWARE, retain no
  74. copies, and the recipient agrees to the terms of this
  75. License.  You may not reverse engineer, decompile, or
  76. disassemble the SOFTWARE, except to the extent applicable
  77. law expressly prohibits the foregoing restriction.

  80. =============  LIMITED WARRANTY AND REMEDIES  =============
  81. LIMITED WARRANTY.  
  82. ToolPool warrants that the SOFTWARE will perform
  83. substantially in accordance with the accompanying on-line
  84. documentation for a period of 101 days from the date of
  85. receipt.

  87. CUSTOMER REMEDIES. 
  88. ToolPool's entire liability and your exclusive remedy shall
  89. be, at ToolPool's option, either (a) return of the price
  90. paid or (b) repair or replacement of the SOFTWARE that does
  91. not meet this Limited Warranty and that is returned to
  92. ToolPool with a copy of your receipt.  This Limited
  93. Warranty is void if failure of the SOFTWARE has resulted
  94. from accident, abuse, or misapplication. Any replacement
  95. SOFTWARE will be warranted for the remainder of the
  96. original warranty period or thirty (30) days, whichever is
  97. longer.
  98.  
  99. NO OTHER WARRANTIES.  
  100. To the maximum extent permitted by applicable law, ToolPool
  101. disclaims all other warranties, either express or implied,
  102. including but not limited to implied warranties of
  103. merchantability and fitness for a particular purpose, with
  104. respect to the SOFTWARE and any accompanying written
  105. materials.
  106.  
  107. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. 
  108. To the maximum extent permitted by applicable law, in no
  109. event shall ToolPool be liable for any damages whatsoever
  110. (including, without limitation, damages for loss of
  111. business profits, business interruption, loss of business
  112. information, or other pecuniary loss) arising out of the
  113. use or inability to use the SOFTWARE, even if ToolPool has
  114. been advised of the possibility of such damages.
