  3. NAME
  4.        bk bkl - display free use BitKeeper license

  10.        1.  DEFINITIONS
  11.  
  12.        BKL:  This  license in its entirety, also known as the BitKeeper
  13.              License.
  14.  
  15.        You: The licensee of the BitKeeper Software.
  16.  
  17.        BitMover: The licensor of the BitKeeper Software.
  18.  
  19.        BitKeeper Software: The complete set of executable programs  and
  20.              any  accompanying  files,  such as documentation, known as
  21.              the BitKeeper Software.  The set  of  programs  and  files
  22.              must  include  all  files and programs distributed by Bit-
  23.              Mover as part of the BitKeeper Software.
  24.  
  25.        BitKeeper Package: A set of files managed by the same  BitKeeper
  26.              ChangeSet  file.   There  may be multiple instances of the
  27.              package; each instance is called a repository.
  28.  
  29.        Single user BitKeeper Package: A BitKeeper Package  wherein  all
  30.              changes  to  all files are made by the same person and the
  31.              total number of files does not exceed 1000.
  32.  
  33.        Metadata: Information about the data managed  by  the  BitKeeper
  34.              Software in a BitKeeper Package, such as
  35.  
  36.              + The ChangeSet file;
  37.  
  38.              + The  messages  which  annotate modifications of the data
  39.                (also known as check  in  comments,  ChangeLog  entries,
  40.                and/or log messages);
  41.  
  42.              + All  infrastructure  files contained below the top level
  43.                BitKeeper directory in a BitKeeper Package.   User  data
  44.                files,  i.e.,  files  contained in the BitKeeper/deleted
  45.                and  BitKeeper/triggers   directories   are   explicitly
  46.                excluded.
  47.  
  48.        Open  Logging:  The transmission of Metadata about the data man-
  49.              aged by the BitKeeper Software, to a functioning Open Log-
  50.              ging  server in the openlogging.org domain (or an alterna-
  51.              tive  domain  as  posted  on   www.bitkeeper.com/logging).
  52.              Examples  of  such  collected  information  may be seen at
  53.              http://www.openlogging.org.
  54.  
  55.        Conforming Software: BitKeeper Software that:
  56.  
  57.        (i)   passes all of the current,  unmodified,  regression  tests
  58.              for the BitKeeper Software;
  59.  
  60.        (ii)  performs   all  licensing functions, such as Open Logging,
  61.              identically to the current version of the BitKeeper  Soft-
  62.              ware as distributed by BitMover, Inc.
  63.  
  64.        2.  LICENSE GRANTS
  65.  
  66.        Licensees may freely install, use, copy, and distribute Conform-
  67.        ing Software.
  68.  
  69.        3.  LICENSEE OBLIGATIONS
  70.  
  71.        (a)  Maintaining Open Logging Feature: You hereby  warrant  that
  72.             You will not take any action to disable or otherwise inter-
  73.             fere with the Open Logging feature of the  BitKeeper  Soft-
  74.             ware.   You hereby warrant that You will take any necessary
  75.             actions to ensure that the BitKeeper Software  successfully
  76.             transmits  the Metadata to an Open Logging server within 21
  77.             days of the creation of said Metadata.  By transmitting the
  78.             Metadata  to  an Open Logging server, You hereby grant Bit-
  79.             Mover, or any other operator of  an  Open  Logging  server,
  80.             permission  to republish the Metadata sent by the BitKeeper
  81.             Software to the Open Logging server.
  82.  
  83.        (b)  Accessing Others' BitKeeper Package: You may only  use  the
  84.             BitKeeper Software to access a BitKeeper Package created by
  85.             BitMover or third parties if You comply with the license of
  86.             the  BitKeeper  Package,  which  can  be  found at the Bit-
  87.             Keeper/etc/REPO LICENSE file within the  BitKeeper  Package
  88.             and/or by running bk repo license.
  89.  
  90.        (c)  Maintaining  Open Source: It is the intent of BitMover that
  91.             Your use of BitKeeper under this license is for the purpose
  92.             of maintaining Open Source.  By accepting this license, You
  93.             agree that You are prepared  to  demonstrate  Your  confor-
  94.             mance, at the request of BitMover, by making your BitKeeper
  95.             repositories publicly available via the BitKeeper  protocol
  96.             within 15 days from the time of such request.  In the event
  97.             that You do not wish to make  BitKeeper  repositories  pub-
  98.             licly  available,  You have 15 days in which to negotiate a
  99.             waiver, convert said repositories to closed use,  or  cease
  100.             use of said repositories.
  101.  
  102.        (d)  Notwithstanding  any  other  terms  in  this  License, this
  103.             License is not available to You if You and/or your employer
  104.             develop,  produce, sell, and/or resell a product which con-
  105.             tains substantially similar capabilities of  the  BitKeeper
  106.             Software,  or,  in the reasonable opinion of BitMover, com-
  107.             petes with the BitKeeper Software.
  108.  
  109.        (e)  Inclusion with another product having source and/or config-
  110.             uration  management  features:  Inclusion  of the BitKeeper
  111.             Software for use with a system having substantially similar
  112.             capabilities of the BitKeeper Software requires prior writ-
  113.             ten permission from BitMover.
  114.  
  115.        4.  NON-CONFORMING USE
  116.  
  117.        4.1.  Single user packages
  118.  
  119.        For single user BitKeeper Packages, Open Logging is optional.
  120.  
  121.        4.2.  Closed Use
  122.  
  123.        Closed use is the use of the BitKeeper Software without partici-
  124.        pating  in  BKL  licensing  restrictions  such  as Open Logging.
  125.        Closed use of the BitKeeper Software requires that You (or  your
  126.        organization)  purchase closed use licenses for all users of the
  127.        BitKeeper Software within your organization.  This license,  the
  128.        BKL,  does  not  convey authority to make closed use of the Bit-
  129.        Keeper Software.
  130.  
  131.        4.3.  Logging Waivers
  132.  
  133.        Certain sites which do not wish to participate in Open  Logging,
  134.        such  as  educational or research institutes, may apply for, and
  135.        may be granted, a written  waiver  from  BitMover,  Inc.   After
  136.        applying  for  a written waiver, such an institution may use the
  137.        BitKeeper Software without Open Logging, for up to 90  days,  or
  138.        until  a  response  is  received  from BitMover, Inc., whichever
  139.        comes first.  Should BitMover not grant your waiver request, You
  140.        have  the option of converting to Open Logging, immediately ter-
  141.        minating your use of the BitKeeper Software or  continuing  your
  142.        use after purchasing closed use license[s].
  143.  
  144.        4.4.  Damages
  145.  
  146.        Use,  copying,  or  distribution of non-conforming software is a
  147.        violation of copyrights held by BitMover on the BitKeeper  Soft-
  148.        ware.   Damages  for  copyright  infringement are the greater of
  149.        actual damages or statutory damages, which are currently  up  to
  150.        $150,000 per infringement.
  151.  
  152.        This  license is not available to You if You and/or your company
  153.        have any unresolved copyright disputes with BitMover.
  154.  
  155.        5.  DISCLAIMER OF WARRANTY
  156.  
  157.        COVERED CODE IS PROVIDED UNDER THIS  LICENSE  ON  AN  ``AS  IS''
  158.        BASIS,  WITHOUT  WARRANTY OR INDEMNIFICATION OF ANY KIND, EITHER
  159.        EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION,  WARRANTIES
  160.        OR  INDEMNITIES CONCERNING INTELLECTUAL PROPERTIES (E.G. PATENTS
  161.        OR COPYRIGHTS), WARRANTIES THAT THE  COVERED  CODE  IS  FREE  OF
  162.        DEFECTS,  MERCHANTABLE,  FIT  FOR  A  PARTICULAR PURPOSE OR NON-
  163.        INFRINGING.  SHOULD ANY  PORTION  OF  BITKEEPER  SOFTWARE  PROVE
  164.        DEFECTIVE  IN  ANY RESPECT, YOU ASSUME THE COST OF ANY RESULTING
  165.        DAMAGES, NECESSARY SERVICING, REPAIR OR  CORRECTION.  THIS  DIS-
  166.        CLAIMER  OF  WARRANTY  CONSTITUTES  AN  ESSENTIAL  PART  OF THIS
  167.        LICENSE. NO USE OF BITKEEPER SOFTWARE  IS  AUTHORIZED  HEREUNDER
  168.        EXCEPT SUBJECT TO THIS DISCLAIMER.

  170.        6.  TERMINATION
  171.  
  172.        + This  License  and the rights granted hereunder will terminate
  173.          automatically if You fail to comply with terms herein.  Provi-
  174.          sions  which,  by their nature, should remain in effect beyond
  175.          the termination of this License shall survive.
  176.  
  177.        + If any of the licensing requirements, such  as  Open  Logging,
  178.          are found to be unenforceable, then this license automatically
  179.          terminates unless You continue  to  comply  with  all  of  the
  180.          licensing requirements.
  181.  
  182.        + Should  You  or  your organization choose to institute patent,
  183.          copyright, and/or  intellectual  property  litigation  against
  184.          BitMover,  Inc.  with  respect to the BitKeeper Software, then
  185.          this License and the rights granted hereunder  will  terminate
  186.          automatically as of the date such litigation is filed.

  188.        + If  this License is terminated for any reason, You must delete
  189.          all copies of the BitKeeper Software and cease using the  Bit-
  190.          Keeper Software.
  191.  
  192.        7.  LIMITATION OF LIABILITY
  193.  
  194.        TO THE FULL EXTENT ALLOWED BY APPLICABLE LAW, BITMOVER'S LIABIL-
  195.        ITY TO YOU FOR CLAIMS RELATING  TO  THIS  LICENSE,  WHETHER  FOR
  196.        BREACH  OR  IN  TORT,  SHALL  BE  LIMITED TO ONE HUNDRED PERCENT
  197.        (100%) OF THE AMOUNT HAVING THEN ACTUALLY BEEN PAID  BY  YOU  TO
  198.        BITMOVER  FOR  ALL  COPIES  LICENSED HEREUNDER OF THE PARTICULAR
  199.        ITEMS GIVING RISE TO SUCH CLAIM, IF ANY.
  200.  
  201.        IN NO EVENT WILL BITMOVER BE LIABLE FOR ANY INDIRECT,  PUNITIVE,
  202.        SPECIAL,  INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH
  203.        OR ARISING OUT OF THIS LICENSE (INCLUDING,  WITHOUT  LIMITATION,
  204.        LOSS  OF  PROFITS, USE, DATA, OR OTHER ECONOMIC ADVANTAGE), HOW-
  205.        EVER IT ARISES AND ON ANY THEORY OF  LIABILITY,  WHETHER  IN  AN
  206.        ACTION  FOR CONTRACT, STRICT LIABILITY OR TORT (INCLUDING NEGLI-
  207.        GENCE) OR OTHERWISE, WHETHER OR NOT SUCH PARTY HAS BEEN  ADVISED
  208.        OF  THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING THE FAIL-
  209.        URE OF ESSENTIAL PURPOSE OF ANY REMEDY.

  211.        8.  MISCELLANEOUS

  213.        8.1.  Merger
  214.  
  215.        This License represents the complete agreement between  You  and
  216.        BitMover  regarding  the  BitKeeper  Software  covered  by  this
  217.        License.
  218.  
  219.        8.2.  Assignment
  220.  
  221.        BitMover may assign this License, and its rights and obligations
  222.        hereunder, at its sole discretion.
  223.  
  224.        8.3.  Severability
  225.  
  226.        If  any  provision  of this License is held to be unenforceable,
  227.        such provision shall be reformed only to the extent necessary to
  228.        make it enforceable.
  229.  
  230.        8.4.  Governing Law/Jurisdiction
  231.  
  232.        This  License  shall  be  governed by the laws of the US and the
  233.        State of California, as applied to contracts entered into and to
  234.        be  performed  in  California between California residents.   By
  235.        using this product, You submit to the jurisdiction of the courts
  236.        in the Northern District of California.
