LICENSE AGREEMENT

This agreement is a legal contract that specifies the terms
of the license and warranty limitation between you and
Stephen Michael Schimpf for the CyberSky software and any
related documentation. You should carefully read the
following terms before using this software. Unless you have
a different license agreement signed by Stephen Michael
Schimpf, your use of this software indicates your
acceptance of the terms of this agreement.

COPYRIGHT

CyberSky is owned by Stephen Michael Schimpf and is
protected by United States copyright laws and international
treaty provisions. Therefore, you must treat CyberSky like
any other copyrighted material. CyberSky is licensed, not
sold. All rights to the CyberSky software and any related
documentation not expressly granted under this agreement
are reserved by Stephen Michael Schimpf.

REGISTERED VERSION
-----------------------------------------------------------

If you have purchased the registered version of CyberSky,
Stephen Michael Schimpf hereby grants you the following
non-exclusive license:

You may use the registered version of CyberSky on one or
more computers, provided the software is run on only one
computer at any given time, or you have purchased licenses
covering all computers that will run the software at the
same time.

You may use the output of the registered version of
CyberSky for noncommercial purposes, in both electronic and
physical publications, provided you credit CyberSky as the
source. You are encouraged to provide a link to
www.cybersky.com.

You may make copies of the registered version of CyberSky
for the sole purpose of backing up the software and
protecting your investment from loss.

SHAREWARE VERSION
-----------------------------------------------------------

If you have obtained the shareware version of CyberSky,
Stephen Michael Schimpf hereby grants you the following
non-exclusive license:

You may use the shareware version of CyberSky free of
charge on up to 21 separate days for the sole purpose of
evaluating the software. Use of the software beyond this
evaluation period requires that you purchase the registered
version of CyberSky.

You may freely copy and redistribute the shareware version
of CyberSky by electronic means and on physical media,
provided it is distributed in its original, unmodified
form, and that it is not sold for profit.

TERMINATION

This license will terminate immediately if you fail to
comply with any provision of this license.

DISCLAIMER OF WARRANTY

CYBERSKY IS SUPPLIED "AS IS" WITHOUT WARRANTY OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STEPHEN
MICHAEL SCHIMPF DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR
IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
STEPHEN MICHAEL SCHIMPF'S LIABILITY WILL BE LIMITED
EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE
PRICE.

BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE
EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO
YOU.

GOVERNING LAW

If you acquired this product in the United States, this
agreement is governed by the laws of the State of
California.

If this product was acquired outside the United States,
then local law may apply.
