This "Program" (meaning the software known as Astrogeddon Version 1.62, including all its related files and documentation) is copyright Owen Thomas of 2A Berceau Walk, Watford WD17 3BL, United Kingdom (the "Owner") and must not be used, copied, modified, distributed, transmitted, published or otherwise reproduced in any form by any means other than strictly in accordance with this legal agreement (the "Agreement") between you and the Owner. By using, installing or copying the Program you are agreeing to all the following terms:


UNREGISTERED TRIAL VERSION:

 1. You may use the unregistered trial version of the Program for a thirty minute trial period only.

 2. You may distribute the unregistered trial version of the Program, so long as you do not make any modifications or additions to the Program and so long as you only distribute the most current version (as available from www.ortsoftware.com). You will make it clear to those to whom you distribute that continued use of the Program requires payment to the Owner.

 3. You will hold the Owner, as well as the Owner's partners, contractors, employees and agents, harmless from damage, loss and expense arising directly or indirectly from your acts and omissions in copying or distributing the Program.

 4. The Owner reserves the right, upon written notice, to withhold or withdraw permission to distribute the Program from anyone at any time and for any reason.


REGISTERED FULL VERSION:

 1. The Program is licensed, not sold. Once registered, you are granted a non-exclusive licence to install and use the registered full version of the Program on a single computer. You will not make copies for any other purpose.

 2. You must not install the Program on any publicly accessible computer or on any computer outside your home where you are not the main user.

 3. Recognizing the damage to the Owner's business which would result from unauthorized use, duplication or distribution of the Program, you will make every effort to keep both the Program and your Registration Key secure.

 4. The registered full version of the Program may not be rented or leased, but may be permanently transferred so long as: (i) you promptly notify the Owner of the transfer by email, quoting your full name, your Registration Key and the recipient's full name; (ii) you promptly destroy all copies of the Program in your possession; and (iii) the recipient agrees to this Agreement. If the Program is an update, the transfer must include the update and all previous versions.

 5. Free updates to the Program will be released entirely at the Owner's discretion and will only be provided via download from the Owner's website.

 6. Access to the Program's on-line high-score table is at the Owner's discretion. The Owner reserves the right to edit entries in the table, to block individual users and to withdraw the table altogether.


GENERAL TERMS:

 1. You will not modify, clone, emulate, reverse engineer, disassemble or decompile the Program.

 2. The Owner will retain all copyrights to the Program except to the extent expressly specified in this Agreement.

 3. All rights granted to you in this Agreement are non-exclusive, and will be terminated automatically if you breach any of the terms of this Agreement.

 4. If any part of this Agreement is held to be unenforceable for any reason, such part will be reformed only to the extent necessary to make it enforceable and the remainder of this Agreement will not be affected.

 5. THE PROGRAM IS PROVIDED "AS-IS". NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON. THE OWNER WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.

 6. This Agreement will be governed by English Law under the exclusive jurisdiction and venue of the English Courts.


If you do not agree to the above terms, do not use or install the Program and destroy all copies of the Program in your possession. If you have purchased a licence to use the Program, promptly return all related materials with proof of purchase to your place of purchase for a refund.
