He is not prejudging the case: he is not saying it is true. The paragraph started "What if...?". He is asking questions about a hypothetical scenario, not making statements of fact.

He is still speaking hypothetically: *if* McD's is judged to have shown some parts of the leaflet, *then* they will, strictly speaking, have won, although, as Neil points out, it will really be something of a hollow victory. But, legally, it will be a victory, *if* that happens.
