Day 241 - 26 Apr 96 - Page 02
Friday, 26th April 1996.

MR. JUSTICE BELL: Call Mr. Rose.

MR. MORRIS: Yes.

DAVID JACOB EDWARD ROSE, sworn
Examined by the Defendants

MS. STEEL: If you could give your full name to the court,
please?
A. David Jacob Edward Rose.

Q. You live in London at present; is that right?
A. Yes.

Q. Could you give a little bit of history about yourself, your
position now and any details of any awards you have won?

MR. JUSTICE BELL: Is that necessary for what he is going to
relate?

MR. MORRIS: His credibility is important.

MR. RAMPTON: No, his credibility is not under attack.

MR. JUSTICE BELL: I do not know, I do not suppose anyone will
suggest Mr. Rose is other than a perfectly respectable
journalist.

MR. RAMPTON: Can I say for the purpose of this case alone, I
accept Mr. Rose's statement in its entirety.

MR. JUSTICE BELL: I really only need to know about people's
background if they are put forward as an expert.

MS. STEEL: OK.

MR. JUSTICE BELL: If their credibility is attacked, then you
might want to re-examine about something but .....

MS. STEEL: OK. All right. (To the witness): If you could
get down from the bundles behind you -- I am not sure which
one it is in.

MR. JUSTICE BELL: It pale blue 1C on the top, Mr. Rose, you
see, with the "1C" on it. Thank you. Near the front of
divider G and then behind that, divider 1.

MS. STEEL: If I could say, I think that the wrong statement is
at the front because what happened was we originally served
the statement, the proof which is headed, the proof of
story Greenpeace -- which I think in the bundle is the
second page, but I might be wrong -- requested by Rose on
20th July 1993 at 16, 34, 58, and that is the actual real
statement.

MR. JUSTICE BELL: I have something which is "Attention Dave
Morris, London Greenpeace".
