Day 146 - 03 Jul 95 - Page 02

                                     Monday, 3rd July, 1995.

                           (IN CHAMBERS)

MR. RAMPTON: My Lord, does your Lordship have our agenda, our
       typed written agenda ---

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: -- that we handed up a few days ago.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: Can I tell your Lordship the order in which,
subject to any feelings your Lordship may have about the
matter, the order in which I would like to deal with the
items on our agenda? I want to start with something which
is not on the agenda which is the matter I mentioned
briefly in open court at the end of last week.

MS. STEEL: Can I say, if this is -- I do not know -- but when
we actually asked the Plaintiffs about this after court, we
were told we were going to be sent a letter about this and
we have not received it, so we are not entirely sure what
this is about. So, I think it would be better if we got
the letters and then had time to talk to somebody about it.

MR. RAMPTON: I am told there was no letter promised; I do not
       propose to send -----

  MS. STEEL: There was.

MR. RAMPTON: I do not propose to send a letter. A letter has
already been written on this topic on 10th March of last
without any response from the Defendants.

MS. STEEL: I want to refute that. I was told on Friday evening
we would be sent a letter about this, most definitely.

MR. JUSTICE BELL: Let us hear what it is and then if you are
caught out in any way and need more time we will consider
       that.

MR. RAMPTON: It is not an application. It is something I feel
duty bound as counsel in the case to mention to your
Lordship, because I would very much appreciate having your
Lordship's view before my clients make any decision on the
matter. My Lord, after that, I will go, if I may, straight
to item 7 which is scheduling. Then to item 6, then to
item 2, then to item 10 which is, perhaps, really part of
       7. Then after 10, the Hovi question, Hovi/Bone question
       which is 9.

Then I will sit down after that and leave Mr. Atkinson to
deal with items 3 and 5 in whichever order he prefers. The
reason for that is that I am not up to speed on the
counterclaim and he is the master of that. So, if your
Lordship will permit me, I will leave items 3 and 5 to
him. All the others, I believe, we have already dealt with
       on our list.
