                                     Thursday, 27th April, 1995.

                MR. SIDNEY THOMAS NICHOLSON, continued.
                   Examined by Mr. Rampton, continued.

MR. RAMPTON: Mr. Nicholson, at the end of yesterday I promised
we would come to promotion (which we now shall) within
McDonald's. Could you see if you can find at your right
hand the pink volume XI, please?
       A. Yes.

  Q. Turn to tab 3, please, page 137.
       A. Yes.

  Q. Which should be a section in the Crew Handbook for 1989
       headed "Promotion", is it?
       A. Yes.

  Q. I will read it, if I may: "McDonald's policy is to
actively promote from within. If you do well as a crew
person, your manager may consider you for promotion to
Dining Area Hostess, Training Squad, Training Co-ordinator
or Floor Manager. These jobs are offered to employees who
show initiative and a desire to advance. Higher rates of
pay are given for these extra responsibilities. Many of
our finest managers and senior company personnel have been
promoted from crew. Ask your manager about the entry
requirements for trainee management or the junior business
management programme or write to the personnel department
       regional office".

Mr. Nicholson, are these just fine words?
       A. Certainly not.

  Q. Is that policy stated here of active promotion within the
       Company carried out in practice?
       A. Most certainly.

  Q. There is a passage in your statement dealing with this
question of promotion from crew to management?
       A. Yes.

  Q. Do you remember that?
       A. Yes, I do.

  Q. My Lord, it is paragraph 23. There are, I think, a couple
of mistakes in it. Have you the yellow volume there?
       A. Yes, I have.

  Q. Your first statement is at tab 1. If you would not mind
finding paragraph 22 for yourself? I think it is on page
       9.

MR. JUSTICE BELL: The statement has not been read into
       Mr. Nicholson's evidence.

MR. RAMPTON: No, my Lord, it has not. The tenth line down,
Mr. Nicholson, well the line above, there are three short
words at the end of the line "In 1999 of"?
       A. 1989.
