Day 087 - 10 Feb 95 - Page 04

until" -- the point is that if I put it down somewhere
here, it will just go absent without leave, that is bound
to happen. If I hand it back to Mr. Morris, he may or may
not remember it. If you put it in the folder, it is
there. I am not going to read any more than I have to in
this case and I will not read that until I am invited to.

  MR. RAMPTON: No, very well.

MR. MORRIS: Related to that document, numbers 29 to 35 are the
photographs that Mr. McIntyre took of environment/index.html">litter.

MR. RAMPTON: My Lord, as to those, though I am in a sense
speaking against what I said a moment ago, we had rather
hoped that we might be able to make coloured copies of
those photographs because, I do not know, I have a
recollection that the black and white ones are not a lot of
help because the colour of the actual items may assist in
assessment of the issues in the case.

MR. MORRIS: We will give the Plaintiffs the originals for a
period and they can copy them if they wish.

MR. JUSTICE BELL: The function they will serve at the moment is
that they will remind me generally what that number
photograph was of, and I can ask to look at a colour one if
we have not got coloured copies if I want to. So, that has
gone into my tab 15. Before we go any further, I want to
put Mr. Hopkins away. Can you remind me which bundle he
       was?

  MR. MORRIS: Defendants' witness statements.

MS. STEEL: It is probably bundle I of the Defendants' witness
       statements.

MR. JUSTICE BELL: It is bundle 1B, section C. Since I have
turned that up, I will remind you that I already had a
number of documents which I was asked to put behind
Mr. Hopkins, and you may think whether they should go into
the document bundle or stay where they are.

MR. RAMPTON: My Lord, it is probably easier if they stay where
they are on the whole. My Lord, I suggest that this new
statement by Ms. Link should go in volume 1B in section C.

MR. JUSTICE BELL: Yes, I have put it in section C tab 4 behind
the first addendum to Mr. Hopkins' statement.

MR. MORRIS: I think we are talking about two different things.
There is Hopkins' stuff and there is the statement I have
just handed to Mr. Rampton from Ms. Link.

MR. RAMPTON: That is where I am suggesting Ms. Link should go.

MR. JUSTICE BELL: I will put that No. 5 in my index.

MR. MORRIS: Did you receive the statement of Ms. Anne Link?

  MR. JUSTICE BELL: Yes.
