Day 071 - 11 Jan 95 - Page 02
11th January, 1995.

MR. MORRIS: May I start with a couple of administrative
matters? We have a further witness statement which is
relevant to food hygiene.

MR. JUSTICE BELL: Yes.

MR. MORRIS: It is a Dr. Steven Dealer, an expert on BSE in
cattle. I believe actually he sent a copy of his statement
to McDonald's a couple of weeks ago, but that is the first
time it has been formally served today.

MR. JUSTICE BELL: Leave it there for a moment. When
Mr. Rampton has had time to look at it, he can say what he
wishes.

MR. MORRIS: Just a couple of matters about the timetable or
maybe the documentation first. I presume that you received
a number of letters beforehand. We have proposed a sort of
method of co-operation with the Plaintiffs both on
documentation and on time-tabling but maybe now is not the
time to go into it, but it might be worth spending some
time at some stage fairly soon to discuss -----

MR. JUSTICE BELL: I suggest that between yourselves you discuss
when any issues as to time-tabling, either in the immediate
future or the more distant future, can be discussed. Fix a
time some time within the next, I suggest before the middle
of next week anyway, or by the middle of next week when we
can spend half an hour or on hour talking about that, if
need be.

MR. MORRIS: Yes. While we are on the documentation procedure,
it might be worth setting a place to put the Dr. Steven
Dealer statement.

MR. JUSTICE BELL: Leave that for the moment. Hold on to it.
It has been served on McDonald's and I will give
Mr. Rampton an opportunity to say anything he wishes to say
when he has had an opportunity to read it.

MR. MORRIS: Just on the timetable problem, we do not feel that
the draft timetable that has been proposed is realistic.
So, if it is not considered to be a tablet of stone until
we have had this chance to -----

MR. JUSTICE BELL: No, I do not think the timetable ever can be
written in stone, but what I have said is, what I suggest
is we get on with, is it, Mr. or Miss Stacey Stump?

MR. RAMPTON: Mr., my Lord.

MR. JUSTICE BELL: If we move on with Mr. Stacey Stump, then
Mr. Hopkins and you, between you, agree a time early next
week where we can give some half an hour to discuss the
timetable, either the immediate timetable or what you wish
to say about breaks and things like that.

MR. RAMPTON: Mr. Stump, could you go into that witness box,
