     6   MR. JUSTICE BELL:  Having had our procedural applications on
     7        Monday 21st, Tuesday 22nd, if necessary, and kept Wednesday
     8        23rd blank.

    10   MR. RAMPTON:  My Lord, yes.  It would mean, if Mr. Mallinson had
    11        to come back on Wednesday 30th -- I cannot move Professor
    12        Ashworth again -- Mr. Oakley would not then start until
    13        Thursday 1st which would mean a sideways shunt probably of
    14        the Defendants' recycling and waste witnesses to Tuesday
    15        6th or so, but since Thursday and Friday -----

    17   MR. JUSTICE BELL:  If that did happen, who would be on Monday,
    18        28th?

    20   MR. RAMPTON:  Monday, that would still be Mr. Mallinson.

    22   MR. JUSTICE BELL:  And then Tuesday?

    24   MR. RAMPTON:  Tuesday he cannot do and, anyway, I have Mr. Stump
    25        and Professor Ashworth down for Tuesday.

    27   MR. JUSTICE BELL:  Then you are suggesting that Mr. Mallinson
    28        come back on Thursday?

    30   MR. RAMPTON:  Finishes off on Wednesday; both Mr. Stump and
    31        Professor Ashworth will be relatively short witnesses,
    32        I hope; Mr. Mallinson to finish on the Wednesday, I would
    33        hope; Mr. Oakley to start either on Wednesday afternoon or
    34        Thursday morning, remembering, I think it is right, that
    35        the Defendants' only substantial witness on recycling and
    36        waste at the moment is Mr. Hopkins.

    38   MR. JUSTICE BELL:  Unless and until there is another.

    40   MR. RAMPTON:  Yes, unless they reinstate a substitute for
    41        Ms. Carroll.  But, as your Lordship will see, Thursday and
    42        Friday of that week are blank anyway.

    44        My Lord, might I in the light of that hand in a piece of
    45        work which Mrs. Brinley-Codd has done over the weekend?  I
    46        do it for this, reason that your Lordship indicated that at
    47        some stage -- this seemed to us as good a stage as any to
    48        have a preliminary look at it -- your Lordship would like
    49        to have a think about the progress of the case overall.  We
    50        have one for the Defendants.

    52   MR. JUSTICE BELL:  Shall we deal with that first and then the 
    53        matter you have just raised?

    55   MR. RAMPTON:  It is a matter for your Lordship.

    57   MR. JUSTICE BELL:  Yes.  If Mr. Mallinson were to come on Monday
    58        28th and Wednesday 30th, would Ms. Dibb, looking at it as
    59        best one can at the moment, be likely to be able to give
    60        evidence on Thursday 24th and Friday 25th?
