Day 012 - 18 Jul 94 - Page 02

     1
MR. RAMPTON: My Lord, before I call Mr. Horwitz, there are
2 some documents to be added to your Lordship's files.
Might it be convenient to do it now?
     3
         MR. JUSTICE BELL: Yes. (Handed).
     4
MR. RAMPTON: The first clip ought to be an update of
5 correspondence which needs to go back in your Lordship's
correspondence file. It is in date order.
     6
MR. JUSTICE BELL: Is that with an attendance note?
     7
         MR. RAMPTON: Yes.
     8
MR. MORRIS: Which ones are we talking about? Sorry, we have
     9 not seen it.

10 MR. JUSTICE BELL: That is a separate bundle, is it?

    11 MR. RAMPTON: Inter-parties correspondence.

12 MS STEEL: We have not seen a copy of the attendance note.
              (Handed).
    13
MR. JUSTICE BELL: Does that go at the back, Mr. Rampton?
    14
MR. RAMPTON: It goes at the back, my Lord, yes.
    15
MR. JUSTICE BELL: Can I just hand my correspondence back
16 because I have found those as well just in the rack. They
may have fallen out if it has come undone. We will be
    17 needing it this morning?

    18 MR. RAMPTON: No.

19 MR. JUSTICE BELL: I wonder whether Mr. Atkinson will check?

20 MR. RAMPTON: There are two documents relating to the evidence
of Professor Duxbury. One looks like that which is, in
21 fact, a document which, as I said at the time, I did not
have but had been sent to Professor Duxbury; it was the
22 basis for his calculation of the amount in kilo tonnes of
HCFC-22 used by McDonald's in 1991. It is a document which
23 emanates from Perseco, although it has Mr. Cesca's
reference on the bottom. The page number, my Lord, should
24 be ignored because that is simply the page number in the
bundle which was sent to Professor Duxbury.
    25
MR. JUSTICE BELL: So where should that go?
    26
MR. RAMPTON: Behind Mr. Kouchkous' first statement volume
27 yellow III, tab 3, since he is the author of the document
or the information. Then, my Lord, there is a three-page
28 extract from a book which Professor Duxbury had in the
witness box called Greenhouses Gases and Aerosols. It has
29 the table of which he spoke on the first page 20. We
suggest that should go behind Professor Duxbury's
30 statement in yellow IV; Professor Duxbury's statement is
the first one in the volume.
