LICENSE AGREEMENT

Cool Beans CPU Meter ("Software") is distributed as Freeware. You may use this software on any number of computers for as long as you like. The software is NOT Public Domain software. We allow the free distribution of the software, but Cool Beans Software ("Author") retains ownership and copyright of the software and its source code in its entirety. You may use and/or distribute the software only subject to the following conditions: 

-You may not modify the program or documentation files in any way. 
-You must include all the files that were in the original distribution. 
-You may not decompile or otherwise reduce the Software to a human perceivable form.
-You may not sell the Software or charge a distribution fee, except to recover the media costs.
-You understand and agree with this license and with the disclaimer of warranty and the limitation of liability printed below.
 
The Software may be bundled and distributed together with other software products but the same conditions apply. 

DISCLAIMER OF WARRANTIES AND OF TECHNICAL SUPPORT

The Software is provided to you free of charge, and on an "AS IS" basis, without any technical support or warranty of any kind from the Author including, without limitation, a warranty of merchantability, fitness for a particular purpose, and non-infringement. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.

LIMITATION OF DAMAGES

NEITHER THE AUTHOR NOR ITS SUPPLIERS SHALL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOSS (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF THE AUTHOR OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

This Agreement shall be governed by the internal laws of the State of Ohio. This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
